Got Parking Fine When Ticket Machine Didn't Issue Ticket (ACT)

Hey everyone

I got a ticket a month ago. I parked at 7:59 at Canberra CBD. The fine was issued at 8:40pm however ticket machine doesn't issue tickets after 8:00pm on Friday nights.

I asked for a review and now they ask me to go to court. Should I fight for it?

I took a photo of the ticket machine that it shows it doesn't issue ticket after 8pm.

Here is the picture of the machine:

What? It looks like the machine is functioning. If it's not functioning, go find another machine. It clearly says Friday is paid until 2100h.

Oops. Just gotta be careful next time.

Edit. You parked at 7.59…but the time is 7.36 on the pic.

He went back and took the picture, shows today's date on the machine.

Where does it say that on the machine? Think you need to check the photo again.

Should have gone to Specsavers mate!

  • According to that you got there at 706pm, and carpark has a 30min limit

    • He went back to take the photo for us. But yes, the 30 minute limit applies.

You should definitely take it to court. Argue that you're morally opposed to daylight savings.

The maximum is reached because it is a 30 minute parking zone and you have put in enough for 30 minutes, not because it doesn't issue tickets after 8pm.

Even if the machine is not working, time limits still apply. If you parked at 759 and got a ticket at 840, you exceeded the 30 min time limit so they can issue a ticket.

  • Do you know how much you were fined?

Machine says ticketed on Fridays until 9pm. Can't see anywhere that it says no tickets issued after 8pm. If it was fault, did you report it at the time?

Two things you could do to go to court:
    1. Argue that 9.00pm looked like 8.00pm because the artificial lighting is sufficient.
    2. 9.00pm is grammatically incorrect as it should have been 9:00pm.

  • it does say… if faulty go to the next machine…
