Buyer Failed to Transfer Rego

Hi guys,

Would like to get your advice. Sold a vehicle with no RWC but with rego with the agreement that the buyer would obtain RWC and transfer. They havent and I have found out through citylink tolls fines.

Is there anything I can do? To indicate to vicroads that the vehicle isnt under my control anymore?

    so you sold it contrary to the VicRoads rules? and now you want to fix your (profanity) up?

    maybe go to VR and tell them what you did and tell them the name of the new owner…..assuming you know that?

  • You can nominate another driver for the toll or just pay it and put it down as lesson. Regardless, be sure to cancel the rego. They'll then be driving around with an unregistered car the cops love dishing out fines for that.

    you learn from your life mistakes you should have submitted the transfer docs yourself or sold the car unregistered. if car is still in your name you can cancel the rego right away and get a refund if you surrender the plates. if not just say they were stolen if you dont have them, call buyer tell them you will cancel rego if they dont pay up. i sold a car to a dealer but forgot to cancel the toll tag and had to take the toll bills to dealer to get reimbursed. don't ever loose the receipt of sale make a copy. if u didn't give them one you can contact buyer they them if they dont pay the bills and submit the transfer docs you may be forced report car stolen.

      DO NOT say the plates were stolen

      simply say the car was sold and the plates went with the car and you don't have access to the car anymore

      VR CANNOT refuse your cancellation request simply because you don't have the plates

      why do some people suggest lying to government agencies?……….it can only land you in the brown stuff

    Firstly, I would try and contact the buyer. Basically, to totally end your liability with the traffic fines, you are going to cancel the rego on them. This could have serious consequences, so I would advocate some type of contact.

    Each notice will have a way to say you weren't driving/not at fault. If it doesn't, then a stat dec that you sold the vehicle and weren't driving is enough to end your liability. This was advised to me by the QLD police, I'm not exactly sure if it's the same in Victoria. Once you send a stat dec it usually stops fines with that company. They may claim to require more evidence, but the stat dec is enough as per the police.

    After you have dealt with each agency, you also ideally contact the Police themselves and Vicroads. Technically, you have committed a crime by selling a vehicle with rego and no rwc, so the Police are somewhat hesitant to help. This depends on who you speak to. They may or may not flag the plates as not being in your possession and note that the driver is getting fines in your name. This is to stop larger infringements if you get a lot of unpaid fines.

    After this, there is a process with Vicroads to cancel your rego without having the plates. This may require another stat dec. It is probably best to check with each agency in these steps as to the exact process.

      Police deal with criminal matters.

      Nothing here is vaguely criminal. You will be wasting their time and yours.

      The only people the OP needs to talk to is VR. Only VR can put notations on rego plates. But that does not help the OP. He/she needs to cancel the rego and put the car in the new name or if they don't have that name, then use "unknown" as name and "unknown" as address. VR do this everyday.

      If they choose to nominate the buyer for any fines that come through the post, that is all fine and dandy.

      • I've just noted that the process is different in QLD and VIC. Seems like they are more lenient, in that you have 28 days to supply the RWC after sale. Not sure if 28 days have passed in this instance.

        After the rego is cancelled, the OP may still receive fines (including unregistered vehicle fines) as he was the last registered owner of the plates. It depends on if the new driver accidentally received the fines or knows the system and continues to exploit.

    • Selling a car with rego and no rwc is not a criminal offence.

  • Yeah I messed up :/ I will try contact the buyer. I dont have the plates so that is an issue.
