ACCC Warranty for Second Hand Alienware?

I bought a second hand alienware laptop for $1,000 which was valued about $2,400. It's out of warranty by 4 months and is now overheating.

Can I call Dell and still get the laptop repaired by telling them about ACCC?
If any one has done this with second hand product,please guide me.

    Open it up and clean out the dust?

    • I was recommended to change the thermal paste but this model is too difficult. have to open the whole laptop and I find it really risky.

    overheating laptops are not always a hardware fault, could be just dust buildup.

    Yes, you can quote your statutory rights to dell, and they will propably fix it if its within 2 years of purchase. Second hand or first hand isnt relevant, as long as you transferred ownership to your name.

    Also certain models have an overheating manufacturers fault, maybe look into that as well.

  • Yes, I have the original receipt of the owner and I just applied in Dell to change ownership. I didn't know I could change ownership like that. It says it will take 10 days but not sure how I will be notified.

  • Dell are usually pretty good at coming to the party with just out of warranty laptops especially if you mention it's been an ongoing problem since it was in warranty. Alienwares do run hot especially if you're running them constantly - are you a WoW player?

    Alienware laptops are hard to do DIY repairs on, but I'd try at least to clear the dust out from the fans. You're right it could be the thermal paste but I doubt it

    how long was the original warranty?
    Also for dell to fix the laptop it will have to be a manufacturing defect.

        Was it a 1 year or 2 year or 3 year warranty?
        its easy to argue that a 1year 4 moth old laptop bought for $2400 should not be heating up vs 3 year 4 month laptop.

        • oo.. It's had only 1 year warranty and was purchased by the original owner in Jan of 2016.
          Too add more, I went to Dell site and did the procedure for changing ownership but I never got any confirmation mail about the process.

  • Tricky situation as I thought the statutory protections offered to 'consumers' would not legally apply here.

    There's two different things; there's the warranty against defects which is offered by the original seller/merchant/etc and is usually transferable, and then there's the consumer guarantee under Australian consumer law around fit for purpose/quality/etc.

    The latter would only be between you and the immediate seller (rather than the original seller), but would not apply to most person to person sales (vs buying from a 2nd hand computer shop).

    IMO best bet is if the person you bought it off made a claim against Alienware/Dell under the consumer law rather than you since I think they (technically/legally) owe you nothing.

    That being said, Alienware/Dell have been quite good with any claims in the past from what I've experienced when things went wrong so they may very well help out of goodwill/policy rather than any actual legal requirement to do so.

    The easiest thing is to ask dell nicely first. You dont have to go in all ACCC/statutory gun blazing right from the start.

    Private sales are usually a ‘verbal contract’ between the buyer and seller. Unfortunately, a breach of a verbal contract is difficult to prove. If you have lost money buying privately, contact a solicitor for legal advice.

    I had an experience with Dell recently in regards to a secondhand Latitude E5440 which had a line running down the LCD screen due to a LCD cable defect.

    The warranty had expired 2 months after the initial 3 year period, but I had contacted Dell customer support and explained the situation, along with ACL guidelines. They upgraded the case to executive relations who had passed it all clear and provided an on-site technician to repair it free of charge.

    Note I didn't have to provide them a receipt or proof of ownership, simply the service tag was in enough in this situation.

    I called Dell tuesday and they did some remote software check and today i just got scheduled for an on site technician to replace my heatsink and fans. I did not have to even state ACL and ACCC. First they said to do mail in repair which would take atleast 15 days but further request acctually got them come to me.

    I am really feeling relieved. Thanks for the tips guys. Cheers :)
