Section 32 Not Disclosing Insurance Claims History

Quick question, we purchased a townhouse last year and on the Section 32 under the strata building insurance section, the insurance document didn't disclose the claims history on the policy docs. Since purchasing and now negotiating on premiums for year ahead we've found that a claim had been made for water damage some months before us purchasing.

Is it mandatory for a Section 32 to disclose insurance claims history, we're a little annoyed that this was left off and find it pretty misleading. We're happy with the property and I don't see any major faults…. but I just wanted to get an opinion on this from someone in this area….. Many thanks

  • Dont know Victorian legislation, but Section 32 will be a reference to relevant legislation related to the sale of property and no doubt sets out what is required to be disclosed.

    Edit: a quick glance would suggest it is not information which is required to be disclosed.

  • S32 is just a statement of what facilities that are on or supplied to the property. Such as phone and internet connected to Optus, water supply, electrical from xyz, etc. Insurance history is definitely not a required item.

  • Your answer is in the due diligence checklist at the end of the Vendors Statement. You need to make your own enquiries regarding the legality, faults, damage to the property.
