Cancelled MacBook order from Myer over the last two weeks

Just wondering whether anyone got their recent Macbook pro or apple laptop purchased from Myer ebay store cancelled. Mine was cancelled this afternoon eventhough I received an email on Monday confirming the purchase.

Funny though is that they continued selling the item since last week until this afternoon and have the guts to say sorry, your item was cancelled because it is out of stock.

It looks like someone is sleeping on the job or Myer is doing some sort of s**m here, maybe selling stocks which they do not have.

Just interested to find out if many buyers are in this kind of situation or maybe I am the only one.

  • I thought eBay purchases were a legal contract. You can use this fact to pressure them to honouring their contract.

I know when the tables are turned, the sellers can be quite a duck to you when you say you have no monies.

That doesn't sound right, can you link me something that mentions that or are you just talking out of your ass?

        MT2010 you have my commiserations.

Moneybaby are you normally this rude?

So in your world if it doesn't sound right to YOU, you accuse people of talking out of their ass?

Educate your self. There's many examples were Ebay contracts have been enforced.

I specifically refer you to the Auslii database.

EBay does not, in fact, conduct actual auctions and 'persons or businesses that assist sellers in placing items for sale on eBay are not conducting an auction or acting as auctioneers'. … It clearly demonstrated that the contract formed on eBay was a binding agreement and ordered that the seller complete the transaction.

Sorry :) If you think my comments have broken any rules then feel free to report it and mods will remove it if they see fit.

But that article is discussing auctions, this clearly was not an auction. Every example I have come across have been auctions. Can you provide another source that deals with listings?

Also, sellers are entitled to cancel transactions according to eBay.

i can't be bothered reading all of that this early in the morning. but skimming the headings suggests the article is about ebay sellers listing items for sale as auction-style listings. did myer list this item as bin or auction-style?

You don't get to change your statement because you're proven wrong.

You clearly responded to "I thought eBay purchases were a legal contract."

        • @Azzy: So you can't link anything regarding eBay listings being a legal contract and not auctions? Goodbye then.

        • @moneybaby:

Is that you taking you ball and going home?

        • @Azzy: Good luck enforcing this legal contract for future eBay purchases!

  • take to fair trading do not pas go. until they clarify how an Australian with access to stock can do that.

Meyer Ebay need to provide a reason, only get out of jail could be last years model that you bought.

    • Meyer Ebay need to provide a reason,

op state that myer did provide a reason. a good one by the looks of it.

      • not a good one at all

if they are still selling the units now 2 weeks after you can't seriously be that naive.

it can actually be deemed fraud selling units that you take payment for and don't honour

maybe once you have woken up you will see a little more clearly

        • If you believe that Myer has committed an offence, then why not make a complaint to the accc/fair trading/consumer affairs in your state?

My opinion is that their stock management isn't the best and they sold it by mistake.

        • @whooah1979: try again and address the right person i didn't buy one

        • @whooah1979: my first comment exactly

  • Noo… Don't tell me that. Just ordered one yesterday..

  • Myer has done same thing with me twice - first with Galaxy tab 1 and then on Bose sound speaker. In both cases Myer took money, order cancelled after 1-2 weeks and refunded money. No discussion or any voucher compensation. Simply sorry, no stock. So no more clearance electronics from Myer.

  • I ordered iPad during last sale. Got the mail that the C&C centre does not the stock so sourcing and sending it by auspost. Called the customer care asking if they can change the C&C store to another store where I can see it's available. Politely refused as they don't have the authority. Hope the order does not get cancelled at the end

  • Thank you all for your comments.

The reason for not going to ACCC/Fair trading/Consumer affairs is that I do not know how many people are affected when purchasing macbooks from Myer through ebay, hence my post.

If 80%-90% of people who bought from Myer ebay recently have been affected by the cancellation, then Myer has knowingly sold stocks which they don't have, which can lead to a full ACCC investigation. If less than 20% then maybe Myer has a shi**y stock tracking software or the people managing it are incompetent.

Thank you all for your comments.

  • Finally my iPad order cancelled as well .. boo Myer ..wats next step
