Cargo Got Held in The Custom. New Rules Came in after Our Cargo Got Shipped. What Do We Do?

Hi Ozbargainers.

Our cargo containing some milk tea ingredients was shipped out of Taiwan on roughly 1/09/2017.

Unfortunately, there was a new BICON(Australian Biosecurity Import Conditions) rule came out on 9th Sept, which stopped some of our goods cleared from custom clearance.

So this new rule came up after we ordered and shipped our goods. Now we will be paying almost $1000/day for custom storage in the depot waiting for a part of the goods to get destoryed. The total value of those goods is only around $4000

Alright, what should we do in this case? I obviously do not want to $$$$ for the storage. It might not be our fault as the new rule came in after the order and shipping of the goods.

Would lodging an complaint to custom work? Do you think we can get the custom to pay those storage fee as it is not us not obeying the import rule. The new rule is not expected by neither the import company nor us

    How could you possibly be liable for storage if customs has made the decision to hold your goods?

  • The total value of those goods is only around $4000

    $4000 isn't much. Is this lcl? You're probably better of asking bf to destroy the shipment.

    • It isnt much in comparison to the $1000 per day for storage, would you rather have lost $4000 guaranteed, or $1000 per day for who knows how long.

    • I did ask them to destroyed the good stopping everything else got cleared.
      Now it is waiting to be destroyed, that's why I'm paying the storage fee.

        Yeah i understood that after the fact, i guess all you can do is make a complaint, or ask for a review.

  • I assume you're referring to this rule:

    Please be advised that import requirements for the following goods have been removed from the BICON case Dairy products for human consumption and placed in the new BICON case Protein powders and body building supplements for human consumption.

    It seems pretty outlandish to have a change occur and not be given a more lenient amount of notice. When were you made aware of it? It's definitely an issue you should escalate!

    • Nice found. We were aware until the custom gave us the notice(that's when cargo arrives at the custom. But even if we were aware this earlier, we won't have enough time to get the permit. The goods will be sitting there anyway.

  • Normally rules aren't made and implemented on the same day. Normally there would be some forewarning that a new rule is coming. Was it the case for this ruling?
