Samsung sold defective Galaxy S8, replacement provided but Refurb Unit - Should I come back and ask for a brand new phone?

Just wondering if anyone has been through a similar issue and can share the experience to help me.

I bought an S8 under Optus contract back in May. The phone was a defective unit, which kept dropping out of signal and every phone call was interrupted/disconnected. I had a work Iphone and was too busy to go in the store to make a claim up until yesterday.

Went into Samsung Store in High Point. They tested the unit and concluded that it was faulty as per my description. They offered a replacement unit however was a refurbished S8. They said it was the last replacement unit they had available.

I didn't like it that much but took the phone knowing that I will be too busy/cant be bothered to come back again. It works fine so far but I was wondering if I could press on to ask for a brand new replacement. The thing was defective out of the box.

    in any case, May… was many months ago. I don't think it is possible to ask for yet another replacement unit..

    • I think you missed the point, they claimed it yesterday, the original was bought in may. At least that is how I read the OP

      We really aren't clear on when it became faulty

  • I've had a similar experience with Apple and am now on my third replacement/refurbished iPhone6 plus under warranty.
    In hindsight I agree, a refurbished phone doesn't meet the criteria for a full replacement. Only now do I realise after my third replacement that it isn't such a good deal. Initially I felt great, I get a brand new phone but after a while you see it is not a brand new phone.
    There are some glitches I've noticed lately, with the phone freezing and generally slow, I might take it back!

    • When Apple gives you a "new" phone as a replacement, I was told it is new- ie not a refurbish phone (by Apple staff.) I cracked my screen a while back and I had Applecare+, so they just go to the back and got me a "new" one, not sure is brand new or a refurbish one.

    • How did you eventually know that it was a refurbished handset?

      • On the second replacement, the Apple "genius" told me it is refurbished and you can see it is not in the same box as a "new" one

        That's exactly what I was thinking. It did slow down after the iOS 11 update.
        I no longer trust Apple and won't be upgrading to the stupid X.
        Jobs knew what he was doing but the clowns that are in charge now are clueless!

    ACCC laws on warranty refunds, replacements and repairs…

    You are entitled to a replacement, repair or refund. There is no law that says they must give you a brand new item. You were offered a replacement and you took that option.

    So you waited 6 MONTHS and expect a new phone…. hahahahahhahaha no.

    With the six month delay you have shot yourself in the foot. Six months ago I would have said, brand new or cancel the contract. Now … try your luck, but you may well get no joy.

    That said, Optus are known *&@#$ when it comes to this sort of thing. I had a very broadly similar story from years ago and they just didn't want to know about it.

  • I’m impressed that Samsung now offer replacements on the spot. In the past I had to wait about a week for a replacement device. Although I did receive a new device, I would have been happy with a refurbished one.
