Lawyer to write Terms and Condition and Privacy Policy for Mobile App

Hi Guys,

Any suggestion for a lawyer for writing Terms and Condition and Privacy Policy for Mobile App? Who doesn't charge heaps?

    Google a template and fill it in yourself

    • Initially, we thought the same.
      But we are building service providing app, and we will be collecting personal info, pictures etc.
      So we want to secure us with professional help and avoid the loopholes. better safe than sorry

        Get one off the internet, get a lawyer to review, comment, and amend as needed.

    Responsible advice: Go talk to one of the bigger outfits in the city, they'll all charge about the same, and it'll all cost an arm and a leg, but if you're doing what all app-makers these days are doing (i.e. hoping for it to take off and make bank), it'll be a good long-term investment because the kinds of investors and/or financiers you'll be chasing if you're anywhere near halfway successful won't touch your app if it doesn't have competent terms and is a legal minefield.

    OzBargain advice: Go sign up to another app that does the same thing you do and that's based out of Australia, copy their terms and conditions. (NOTE: This is likely copyright infringement, the T&Cs you copy may not be suitable for what you're doing, you won't KNOW what the T&Cs actually do if you don't go to a lawyer, and is generally A BAD IDEA. But it'll be cheap.)

    It is exhaustive, and I believe if you adapt and follow it you would have a very good case to say you were seeking to apply best practice privacy processes.

      That looks to me like it was last updated in 2010? I think that there were changes to Australian privacy law in 2014. There's a reasonable amount of useful general information on the Office of the Australian Information Commissioner website.

      I think a benefit of a lawyer is determining whether you would be classed as an "APP entity" and the scope of both your privacy policy and data handling procedures.

  • Please be aware of the mandatory reporting legislation that was introduced recently for data breaches relating to private data… If you are collecting personal information, you have an obligation to properly manage the data. Asking about on OZB for privacy policies makes me think that either you aren't aware of the obligations you face, or you don't care. Either of which could land you in hot water.

      OP is actually asking for advice on a Lawyer, not advice on the legal document. Sounds like they know exactly what they need to do (ie, seek advice from a legal professional).

    • We are completely aware of it and we also want to protect the privacy of our users. I am on OZB forum to get advise on lawyers.
