Gearbest Scammed me of $800 and refuse to fix after acknowledging problem

Hey guys, so basically I purchased a OnePlus 5T in december of last year off of gearbest for close to $800 and I bought the priority tracked shipping to Australia.

Now I have been waiting nearly a month, GearBest has acknowledged that the package was lost or something and still refuse to give me a refund/replacement even though I havent received the thing I paid for.

They continuously told me to wait 7 days over and over again and now they have offered me 300 bucks back which is complete and utter bs.

A snippet from the last message from them reads:

The shipping company is actually responsible for this loss which is sadly beyond our control.
Please review in detail our shipping and insurance policy in our terms and conditions here: http://www.gearbest.com/about/terms-and-conditions.html

However, as you are a valuable customer, we are willing to help you the best way we possibly can.
Here are the best solutions we can offer you in this situation:

1) Resend the item upon repaying 50% of the order value.
In this case we will send you an invoice to submit the payment of 300 USD via PayPal.
Please confirm your shipping address again

2)Partial refund to your original payment account.
In this case, we can refund 300 USD to your original payment account.

Kindly let us know your decision.
Once again we apologize for any inconvenience caused.

UPDATE 15/01/17: Gearbest Rep PM'd me asking for order info. Lets see if they agree to a full refund or continue with the partial bs

    File a Paypal dispute stating that the item never arrived, if Gearbest cant prove it ever was delivered to you, you will certainly receive your money back.

      What type of postage proof should I submit to PayPal under Seller Protection?
      For items not received, proof of shipment is required.

      Proof of Shipment is an online or physical documentation from a shipping company which should have the following information:

      Status of ‘shipped’ (or equivalent) and the date of postage
      The recipient’s name and address must match those shown on the ‘Transaction Details’ page
      The sender’s name and address must match your name and address
      Online tracking information showing status of shipment

    I had a similar experience, though with a much cheaper product and from a different chinese web store. Was offered the same options, so I ignored their stupid offers and opened a paypal dispute. I won and got my full refund.

      Also have done this in the past. OP just make sure you don't close the dispute even if the seller says they will refund you after you mark the dispute as resolved, only mark it as resolved once you get your money back;

      If the seller offered to refund your money, for example, make sure the money is in your PayPal account before you close the dispute. Once a dispute is closed it can't be reopened or escalated to a claim.

    • same here. I had similar experience from China web store who offered to refund partially and when I refused they tried to renegotiate. Straight away I opened a PayPal dispute and the whole payment was withheld by PayPal. They wrote to me telling all the sob sob stories saying they are losing money etc etc. I just ignored the message and lastly they agreed to refund the whole amount and told me to close the dispute. Once I saw money in my PayPal I closed the dispute.

    Same experience with shop monk where they lost my order (OnePlus 5) through AusPost. They even contacted me by phone and suggested I order the same item again from them again (another $500~), and would give me a refund once they confirmed that Auspost had lost it.. Opened a dispute through PayPal and got a refund soon after.

      • There was tracking but it never updated from when it got shipped :(

  • if you bought the phone using a credit card then call the bank and request a charge back on your card for non receipt of the ordered items.

    You will get a full refund plus once a chargeback is requested it leave a bad mark on the website

        The consumer laws are different in china than they're in Australia. The option of shipping insurance is provided by the supplier to help compensate the customers in case something happens that's out of the suppliers control.

    December was only 13 days ago. I am getting tired of impatient people. If you want it to come fast don't buy from a Chinese site.

      • It's the buyer's responsibility to choose a shipping option that meets their needs. The supplier did provide the buyer with the option of purchasing shipping insurance to cover any loss or damage that may happen outside of the supplier's control.

        • He paid via PayPal which suited his needs of buyer protection.
          Equally, the seller has agreed to them buy accepting PayPal payments

          I take it back. What the hell is wrong with Australia? The UK PayPal requires the seller to prove delivery, not just shipment.

          Aside from that, how can PayPal say "you MAY be eligible for reimbursement if you meet all requirements ".

          I will pay via my UK PayPal in future.
