Smash Repair Didnt Do a Proper Job

Long Story short.
I work for a car rental company so of course i would park my car on street in front of car company. 2 weeks ago, a renter who was returning a truck trying to drive to the drive away and accidentally hit my car’s front right which damaged front right panel, headlight, grill, front bumper and look like the engine bay has been hit too.

Later on, i had some discussion with my boss regarding to the incident, he said he will take care of fixing the damage as the renter has bought insurance for the rental truck. My car has comprehensive insurance but i dont want to lodge a claim with insurance company because my car has been hit whilst parked 4 times and all have been claimed, they said they will increase my premium as i am a high risk customer even though i am NOT at fault for the last many times, thats why i dont wanna make another claim.

2 weeks have passed, finally I received the car back and found out that
- The broken grill has been fixed by glueing it back but it looks good visually,

  • The front bumper has been fixed but it looks like it has been reconditioned.

  • The headlight has been fixed also by reconditioned but i know it is the same one as there are some small scratches that i can recognise.

So can i ask my repairer to replace a new headlight, grill even though they look good visually? Because totally i am not happy having reconditioned parts

Can i ask for the list of parts that they have replaced or even an i voice?

Is there a way to make this right?

Please give me advice or shed me a light.

    • The attached photo is the damage. They have fixed everything and looks good visually but all have reconditioned

  • You certainly can talk to the repairer about doing a better job. Just tell him it isn't good enough.

    Absolutely go back and make them install brand new parts. I wouldn't be happy with that either.

    1. Check the fine print in the rental company’s insurance policy, it may contain clause about using used parts.

    2. Find a new parking spot if you’ve been hit four times.

      First time have been hit at work, the other 4 are at the street that i live, i live in Sydney city/ surry hills to be exact.

    its recent enough that an insurance company would have used new parts. but you're saying your boss sorted it, so a private repairer would just use 2nd hand parts.

    • It is an accord euro late 2010. So because i have agreed to the boss to sort it out himself so i cant do anything further?

      • the boss may have paid x amount for the repair based on the panel beaters quote. So best to talk to the boss about what he agreed to whether it was a private or insurance repair. How good are you with your boss?

        • We are just okay, he pisses everyone off in the office. I just started working here for half a year anw. He is more like a dick. I raised a question about the repaired car, he told me to go ask the repairer on my own.

        • @HenryGalilei: Well then cant go wrong by your bosses recommendation to go back to the repairer to get all new factory parts and send the bill to your boss or the company.

  • This sounds like an insurance issue then workshop.
    - Insurance company send out assessor.
    - Assessor will determine the damage and what needs to be fixed.
    - Insurance will give workshop $X to fix, for parts, etc (your case insurance probably told them to recondition your current headlight instead of replacing with brand new OEM because it was still savagable and cheaper option)
    - Workshop either accepts the job or insurance will give another workshop the job

    Unless the workshop are taking shortcuts to increase their own margins, it’s the insurance company that instructs them to do it.

    Any insurance company that does not give you the option of “choice of repairer” are most likely to follow the above process.
    For the average joe, as long as it looks good on the outside, their happy but anyone with a good eye will be pissed.

    OP even if you complain to the workshop, they will still have to notify the insurance company and get the green light to re-do the job.
    Would of been a lot better to deal with your own insurance and if they decide to rise the premiums, shop around. No such thing as loyalty in the insurance market.
    Don’t think you can get an invoice because you “technically” didn’t pay for it unless the workshop is nice enough.

  • I'm assuming the photo is after the crash?

    Anyway call the repairer and tell them you'll be bringing your car back and expect it to be done properly.

    I personally would have made a not at fault claim, and gone after the renter of the truck through my insurance.

    Cars hitting your cars are considered at fault claims.

  • It wouldn’t surprise me that a rental company had a deal with a smash repairer to repair damage as cheap as possible. It may therefore be a case that the boss organised the repair on the cheap to save some money but didn’t tell the repairer that it wasn’t a rental car, but an employee car.

    There may be a self insured level so the premiums don’t increase. Many businessses will cover up to an amount out of general running costs so the insurance premium can be reduced. Like a 10k excess.

    Technically and legally, you're not at fault for these incidents - but since you've been hit four times while parked, I'd really be questioning your ability to make good decisions on where/how you park!

  • You pay for comprehensive insurance and then choose not to use it … hmmmm. Your choice, carry on.

    On the other hand, you outsource the repair of your car to someone who has an absolute vested interest in getting it done as cheaply as possible. I would imagine that rental car repairs would regularly be done "on the cheap" and it sounds like that's what's happened here.

    • Thats why i now regretted not to use it because i have made a call to insurance company and they said they will raise the premium even i am mot at fault because i have been hit so many times which is a high risk customer. I have been paying almost $1700 per annum for the last 3-4 years. I am 28btw and using GIO

      • Mate, I hear your pain, but ultimately this is what insurance is for. These pages seem to have become littered with gripes about insurance, people not having insurance, people not wanting to use their insurance, people convincing others to get a "cash job" done.

        All these gripes are solved by two recommendations … (1) get your vehicle comprehensively insured if you care about it at all, or third party property as a bare minimum if you're happy to write off your car and suffer the loss and (2) put all matters through your insurer.

        The majority of problems people seem to have relate back to not doing one of these two things.

        I hate to say it, but you are learning an expensive lesson here (even if only measured by time and grief). As soon as you let someone else take control of your outcomes, you need to understand that they will act in their best interests, not necessarily yours.
