Parental Leave

Hi Everyone,

I will be taking Parental leave on 20th March this month and i will be getting 2 weeks Paid leave from Center-link. Just wanted to check with you guys my current employer should give me extra days off or anything else due to Easter public holidays during my 2 weeks Parental leave ?

  • the 2 weeks (10 days) paid leave from centrelink is paid to you if you take that as unpaid leave from your employer,

    a public holiday is paid leave so your

    unpaid leave should be
    20.03 - 29.03 - 8 days
    03.04 - 04.04 - 2 days

    so you take leave on the Tuesday the 20th march and return to work on Thursday 5th of april

    you could try a couple of days of sick/carers leave first before taking the unpaid paternity leave.

    Your employer has to give you unpaid leave for those two weeks - other than that for partners the company doesn’t really have to give you anything. It’s a shame, really.

    • They don’t HAVE to but might have parental leave options better than just provision of unpaid leave

  • public holidays should just be paid day by your company and not erode any leave (paid or otherwise)

    if your company has parental leave policy its generally just paid leave akin to annual leave
    This is not mandatory and many smaller companies will not have this

    you cannot claim this leave (OR annual leave) and Centrelink as well

    Centrelink allows you to claim 10 days (at minimum wage) however you need to take UNPAID leave from work to claim this

    should you want to take additional days, it would generally be off ANNUAL leave or the aforementioned company parental leave

    I guess you are claiming "Dad and Partner Pay"?
    You can claim 2 weeks from Centerlink. 2 weeks, not 10 days. You cannot split it, it has to be taken in 1 continues block.
    Centerlink doesn't care how many days you work as long as you meet the work test. You will get $695.00 per week.
    You must be on unpaid leave during that period. Public holidays are counted as 'work days' so you will not get any extra leave from your employer and you will not get any extra pay during public holidays.

    Put it simple - you will lose your public holidays.

    If I'm you, I will use my annual leave until Easter and start my 2 weeks of unpaid leave on 3 Apr.

    • This - if you put unpaid leave in for a time when there are public holidays you will “lose” them

      As another commenter said, if you put AL for the public holidays and unpaid leave for the non-public holidays then you’re not really taking 2 weeks unpaid leave for which centrelink is paying you, so your payment of roughly $700 a week should be restricted. Have heard people take both paid parental leave from business and the centrelink paid leave to double up, but imagine this is easy for ATO to track given access to bank accounts etc which will show when you get paid and how much?? Anyone done the double up on the downlow?

  • Some companies may refuse to let you take unpaid leave to take advantage of the dad and partner pay. In this case you would need to take something called concurrent parental leave which is where both parent are taking unpaid leave to look after a new born. Concurrent leave is up to 8 weeks I believe and is a fairwork Australia entitlement which you may need to remind your employer.
