Building Pergola/Deck to The Fence (NSW)

Hey All,

I'm hoping someone can point me in the right direction. We are building a deck and pergola out the back of our house. I've read it is exemption if it is 900mm off the boundary but I wanted to know if it possible and what is required if you want to build it up to the fence?

  • what do u mean by exemption. YOu can legally only build to 900mm of the fenceline but you'll need council approval unless u believe youre neighbours wont complain and even then it may be an issue to sell in the future without the right approvals. Just built a pergola in Blacktown council area.

    I'm not an expert but a draftsman quoting for renovation of our Queensland duplex told me building a patio to fence line between duplexes would need neighbour approval (they have to approach them, not just a form) and around $2000 in council costs. Annoying thing was as neighbour also wants to do it to share costs, council will also charge them same amount to have council interview me! Backwards rip off process

    If it meets all the conditions - e.g. less than 900mm from boundaries, sometimes less than 25m2, any enclosing walls less than 1.4m high etc - then you don't need a DA. If you DO want to push it right to the boundary, then you'd apply for a DA and get council approval instead.

    Generally the 900mm for most buildings is due to fire spread between properties (i.e. fire-rated walls if you're house/shop is hard on a boundary); it shouldn't be a significant issue for a pergola that would cause council to deny your application as the fire risk is minimal & doesn't shade the neighbours etc.
