eBay - Item out of Stock - Seller Giving The Run Around

Hi all,

I bought an expensive item from an eBay seller. Shipping date was set to month and half away. The seller seemed to delay any indication of shipping, after multiple messages over a period of a month, they finally discover the item is out of stock. I requested a full refund, but they have yet to comply.

I understand chargeback would get the money back, but I am concerned it may affect my PayPal account in a negative manner.

For now, I think it's best not to put too much detail, as the process is still ongoing.

Any eBay customers/vendors have any advice on the best way to approach this?

Per scrimshaw, it seems like a PayPal dispute might be my best solution at the moment.

Per Hybroid and tuzii, disputing by eBay using the Buyer Guarantee may also be a solution.

Question now is: Should I wait to try the eBay Guarantee first or just send a dispute with PayPal now? Would going for one method invalidate the other, if the prior fails?

Solved: Reminding the seller each day was the solution.

    • Unfortunately I can't yet, since they put the expected arrival date to next month, even though there's no item being sent.

        was there a tracking number supplied to you? Paypal is more likely to get you a refund straight away if the seller is unable to give them a tracking number as proof of goods being shipped out.

        That is of course, assuming it's already past the certain number of days that Paypal gives you the opportunity to open the dispute.

        • The seller hasn't marked the item as sent, nor provided any tracking number, they've also confirmed the item as out of stock. However, I did some research, and apparently, they've issued false tracking numbers in the past when pursuing a PayPal dispute. That's why I haven't tried that approach yet. Thanks for the suggestion!

        i wouldn't wait id contact ebay chat and send them where he has said its out of stock

        • Unfortunately, I did try to contact eBay. On first instance, they couldn't do anything since the expected arrival date was much later and today, they said I'd have to wait till the expected arrival date has passed. Is there a specific method or contact address to get to a person with greater authority from eBay to address these issues?

    This is likely to be scam as means you are over the 30 days eBay guarantee/Paypal protection.

    You need to lodge a dispute as soon as you can and if you cannot, contact eBay immediately. DO NOT WAIT for month and half.

    • I found this on eBay's page:

      A buyer can report in My eBay that they didn't receive an item once the latest estimated delivery date has passed, and for 30 days after the latest estimated delivery date.

      So even despite that, because the seller set an extended expected arrival time, I'd lose out on the Money Back Guarantee? That's rather concerning. Thanks for sharing this!

        It depends what the expected delivery date was on the listing when you bought it. Was it couple days or indeed over a month?

        Either case, contact eBay support and explain your concerns. They can cancel it and refund you and are usually pretty good.

          Well then you're covered. Just a matter of waiting I suppose. Can still contact them and try to get it cancelled if you want.

    the estimated delivery time is 45 days. it looks like you've been nagging the seller for a 30 days while there is still 15 days to go. is that right?

    • Around 40 days I'd say, don't have the exact figure with me at the moment, but yes, it's definitely been a month of messages.

    Why would it affect your PayPal account?

    • To be honest, I've never done a chargeback before. I paid the item with PayPal. I just assumed if I issue a chargeback, my PayPal balance would be negative? Please correct me if I'm wrong, and please also mention if there are any negative outcomes that may arise if I end up having to chargeback.

      • PayPal may put your account on hold if you chargeback. They’ll then ask you to provide documents to verify your identity.

        • What happens after verifying identity? Does the account get un-held?

    Don't do a chargeback until you've exhausted your ebay/PayPal dispute options.

    Just contact the seller, tell them you understand it is out of stock and have arranged to purchase the item elsewhere and would like a refund.

    • That's what I've been trying to do for the past 2 weeks or so, while seeking advice here today in case, that ends up not being possible.
