eBay Dragging on Refund for Nearly Half a Year

I bought an expensive item (over $10,000 AUD) in January and the item arrived weeks after the specified time. As this was a time critical item, I am allowed to get a refund under Australian consumer law if I do not receive the item within a reasonable time frame.

I opened a refund case and after talking to eBay customer service, they confirmed that I had won the case and the refund was arriving within a week.

I have called them at least once a fortnight for nearly half a year and they always say something along the lines of "yeah yeah the refund is on the way, just trust me".

I talked to them for over 2 hours today and asked to speak to a supervisor. They told me that I would have to wait "for a response from the Sydney team".

I asked them if they could provide a concrete date of the refund and they told me that I would get the refund before 10th of June 2018, however I asked them if it was a guarantee; they said "it is out of my control".

I really don't want to be "that" annoying customer or resort to threatening them with "legal action" but I'm sick of waiting. Any advice on what I should do if the refund doesn't arrive by then?

    They are obviously trying to make you wait as long as possible, there must be a reason they arent telling you, so go speak to a solicitor to see what options you have. Maybe open a case with the consumer ombudsman.

      Maybe trying to earn as much interest as possible? Dodgy practice from a big company, but possible.

  • What did the seller say? Did the seller agree? If he didn't, it looks like the funds were taken by him and PayPal has no way of recovering it. If the funds were in his account eBay would've done it on the spot or at least when the item arrived back to seller. Moreover why not open a dispute with Paypal?

    • eBay told me that they are handling the refund with the seller. Should I open a dispute with Paypal now or after June 10th if it doesn't arrive by then?

  • If you paid with a credit card, get a chargeback. Go in to your bank with all the evidence that they agreed to refund, but haven't.

      They recommend you open a dispute with ebay, not paypal now. New policy since last year.

    • Yes I did. eBay asked me to send it back with their label, telling me that I would get a refund soon, but this was months ago.

    Ummm no you're not, this only applies to new items from businesses. If they was a 2nd hand item, from a personal seller, then ACCC doesn't apply.

    • Oh yeah sorry I forgot to mention. It was a brand new item from a large seller on eBay.

    Been 6 months since the item hasn't arrived. Contacted seller and they said that they would resend the package but nothing arrived.
    A few weeks later no more reply was received from the seller.
    Contacted eBay and because it passed the 30 money back thing, they gave me $10 credit for the trouble and was told to contact Paypal as they cover up to 180 days.

      2. The seller outlined the date in the description, as well as the official eBay one. Either way, the item arrived weeks after the specified date on either o f them.

      3. It was due late January/early February but arrived midway through March.

      4. I did not open the package at all but left it until eBay told me that I had won the case and needed to send the item back asap. I sent it asap and sent them the tracking number.

    This is why you should buy with a credit card so you can do a chargeback when things go pear shaped.

  • Lodge a PayPal dispute. You can only do it within 180 daysand you mentioned it has almost been 6 months.

    I bought an item (over $10,000 AUD) on eBay at the start of the year. However, there was some troubles with the shipping so I opened a dispute. eBay agreed to give me a full refund after I returned the item. I returned it and eBay has been telling me "yeah yeah the refund is coming within the next 72 hours" etc, however I've talked to them at least 15 times in the past 6 months and it's always the same story.

    I opened a PayPal dispute and sent them the transcripts between the eBay customer service and I (which showed "yes your refund will arrive in 72 hours" multiple times). However, PayPal denied it as apparently the "transaction has no issues"(regarding to the one in January). I really don't know what to do here, eBay is just holding my refund back and PayPal refuses to do anything.

    Any ideas on what to do?

    • Tell Paypal unless issue resolved by Date X you're going to the Financial Ombudsman

        What obligation does Paypal have here? It seems to be a dispute between OP and either eBay or the seller.

      Just do a charge back with the bank.

      • Yeah I paid with credit card via PayPal. I'll give it a a go and see how it ends. Thanks for the advice.

        • Provide the bank with the emails showing they would provide a refund.

          But just saw this has dragged out for 6+ months, so probably wont work now.

            Depends on the card … but I recently found out that mastercard chargebacks have a limit of 90 days.

            Visa/amex might be longer.
