Advice on eBay Purchase of a Samsung Galaxy S7 Edge Please

I purchased a Samsung Galaxy S7 edge from an australian eBay seller. The item was listed as "new never used". When I received the item, it was clearly second hand. It has scratches all over it consistent with a couple of years of use.

When I questioned the seller, he pointed to a line at the bottom of the ad saying that items may have small marks.

What should I do? I paid a price consistent with other listings for new phones and I always thought the "new never used" category meant new but may not be in a sealed box.

    New: Never Used A new, unused item with absolutely no signs of wear. The item may be missing the original packaging, or in the original packaging but not sealed. The item may be a factory second or a new, unused item with defects. Please see the seller's listing for full details and description of any imperfections.

      How does this tie in with the rest of the description? A factory second will definitely show signs of wear/use.

    a line at the bottom won't hold up and if you leave negative feedback he will have a hard time dealing with that. Calling something "new never used" implies its as new condition.

  • This is why I hate buying phones of Ebay. Fine when its as per what you are expecting not such a good experience when its not to your satisfaction or expectation. Mention then to seller that you are not satisfied that the items was New and never used. Even if as he says the description says it may have small scratches. You are going to return item and request a refund.

    Hoping that you paid via paypal as security. If they don't have a return paperwork system make sure you send back item registered, insured and tracked.

    This is why if I do decide to purchase online the item must still be sealed in original box. The other thing is the phone could be locked out requiring passwords. Sure you can return it again, but its just a hassle. If its sealed at least you know it should be new as expected and untouched.

    As with most of these threads. Was it a reputable seller - store. 100% feedback. I read the feedbacks and generally dont buy from any seller without 100% feedback. You need to minimise your chances of issues. Always pay by paypal. Always ask questions prior to purchase to ensure product in stock or condition of item.

  • The item is SNAD (significantly not as described). This is actually where the seller makes a mistake, because by listing the item as "new, never used" you actually automatically gain more protection via Paypal.

    If the item was listed as "Used" or "Refurbished", then it would be more acceptable that the item has scratches.

    The best thing to do is open a Paypal dispute, if what you want is either a Partial refund or a full refund with the return delivery paid for by Paypal (you'll need to use the Paypal Paid Returns perk)

  • Thanks for all of the advice. The seller wants me to return before I receieve my refund. Should i do this or should i be refunded first?

      Remember when shipping the item back, you must use a service that has tracking and has reliable tracking information. You'll also need to photograph or scan (then upload) the receipts.

      Regular parcel post has tracking, but Registered Post has greater priority. It's going to cost you $4 extra, but you can claim it all back from Paypal anyway, assuming you have activated PP Paid Returns.

      If you haven't, do it now. And also read the terms and conditions.

  • Who was the seller? I bought one too and the box seal was broken, but it was advertised as "BRAND NEW". with tax invoice. lolwtf.
    They also sent the wrong one, ordered black, got silver.
