VicRoads Rule Regarding Electric Skateboard

The law regarding electric skateboard is rather confusing due to contradictory statements on their website

There's this statement:

Wheeled recreational devices cannot be used on separated bicycle paths, but can be used on footpaths

And then:

You are not allowed to use motorised skateboards, roller skates or roller blades on public roads, footpaths or nature strips. But, you can use these on private property.

So can it be used on footpath or not?

  • The second statement can be rewritten as:

"You are not allowed to use motorised skateboards, motorised roller skates, or motorised roller blades on public roads, footpaths or nature strips. But, you can use these on private property."

    • +1

I agree this is a definite prohibition. The first comment most likely means non motorised.

      • Yeah. "Cannot" is definitive and exhaustive. "Can" is saying that a particular prohibition may not apply, but is not a definitive "this can be used here in all circumstances".

  • +3

wheeled recreational devices =/= motorized skateboards.

You can ride your skateboard on footpaths, you can't ride you skateboard anywhere except for private property

  • Ok, had to re-write this post. Went on a rant about scooters and it's about motorised skateboards.

It's pretty clear in the link OP posted…

You are not allowed to use motorised skateboards on public roads, footpaths or nature strips. But, you can use these on private property.

Electric skateboards are not considered a "wheel recreational device" and are therefore prohibited for use in public spaces. VicRoads goes on to give a list of vehicle that are included as a "wheeled recreational device" and "electric skateboard" is not included.

I would say, if your electric skateboard is under 200w, bolt a crude set of handle bars to it and it then becomes an electric scooter… (Oh, and before I forget, remove one of the wheels. scooter = 2 or 3 wheels only… oh, and add some brakes… Or, you know, just buy a scooter… :D)

  • Electric skateboards are prohibited except on private property. Having said that as long as your not causing a nuisance or disrupting traffic or potentially causing safety issue with you and others the officers will leave you alone as it would take them more paperwork and time for them to bother. However, if you happen to get a bored officer wanting to get his fine numbers up. The fine is hefty and believe it's on the spot. The issue is that they cant really define it as a vehicle, but some have enough power to go at a reasonable speed.

I've skated passeds highway police parked on side of road using speed guns. They would more likely think its amusing, however if your weaving in and out of traffic. They will chase you down. By the way always wear helment and protection. Horror stories.

  • That's not contradictory. First one means that electric skateboards can't be used on separated bicycle paths. Second one means electric skateboards can't be used on footpaths either.

  • You need to look at the defeinition of a wheeled recreational device.

  • I'm pretty sure electric skateboards aren't allowed to be used on any public roads or footpaths at the moment. I found an alright article about the eskate laws in Australia that might be helpful.
