Scoopon problem - Diana Hotel Deal

My boyfriend registered with Scoopon and followed a link from an email about an Accommodation super scoopon. I'm not sure if it was an outdated link or not but the deal that came up was for hotel accommodation but in a different state. He bought the Scoopon not realising his mistake. He immediately emailed Scoopon who responded with:
Unfortunately, we are unable to assist your request for refund.

At the time of your purchase, you have accepted the terms and conditions listed on our website. In line with these standard terms and conditions (please see link below) we are unable to provide a refund of your purchase due to accidental purchase, a change of mind, inability to use your Scoopon before the expiry date or as the full terms and conditions of the Scoopon offer have not been read properly - including locations.

I went to the website of the hotel and through their booking feature found that a room with buffet breakfast for 2 people is around $140-$160 for any night I look at. So is the dinner and meant to be worth $300…..I highly doubt it…do you think I have a chance of getting it cancelled based on this information….and if I get no joy from Scoopon is there someone else I can go through in regards to what i believe is false advertising e.g. dept of fair trading?

  • Well, the terms and conditions of the deal say there are no refunds for accidental purchase. You accidentally purchased the deal. You admitted to them you accidentally bought the coupon. I don't see where you have a leg to stand on. I don't understand how you can just buy a coupon for a hotel without knowing where it was…but I'm sure you've probably said the same to your boyfriend.

    That said I've seen people selling their Scoopons on EBAY for a slight profit. Maybe worth a shot.

  • sorry maybe i didnt word it well, i understand they dont refund accidental purchases. There was an accommodation scoopon in adelaide for the same price which was the one he wanted and somewhere between clicking the link in his email and clicking buy the deal he ended up on the brisbane scoopon site….but thats besides the point.

    I was thinking the same about trying to recover the money on ebay. What i am saying is that the voucher is supposedly $452 value yet the actual value of the voucher is a lot closer to $200-$250 at the most. Isnt this false advertising?

    Nobody pays "Rack Rates" for hotels and its almost standard practice in the hotel industry to have massively inflated rates that they never sell them at . Next time check out hotels.com or similar to compare value and their location .

  • I wouldn't think it's false advertising. Hotel rates can change depending on season, time of the week, or booking near a major event. Same thing goes with retail products in a store. It's not 30% of the 40% off they were selling last time but 30% off the original price which they may never actually sell at because there is always a sale (if that makes sense). By quoting the rack rate, it's a steady number.

    Their full rate is listed as $250 on their website, which a random Friday night booking would cost

    $159 friday night stay
    $37 ($18.50 each x2) menu
    $80 2 course dinner menu
    $20 wine, doesn't say for sure
    Total $296
    With their quoted standard rate it comes to $387
    Not sure where the other $75 is coming from…perhaps it's a $200 bottle of wine (doubtful).

    While it's an interesting topic as many group buy sites quote strange numbers, I'm not sure it helps your situation. Still $296 of stuff for $150 is pretty good but I guess probably not if you are travelling to Adelaide and the hotel is in Brisbane.

  • Can you post a link for the accom deal in Adelaide?

    If they are the same hotel group, you might be able to organise to have it transferred across. If not, then it was an almighty careless mistake.

      Looks like the Hotel Diana finished the 17th of February but according to Scoopon Adelaide's recent deals the last hotel deal they had was January 24 for the Rendezvous Hotel which has a similar description and price.

      Although that email would have been sent out on the 23/24 of Jan. Is it possible he signed up for the Brisbane emails by mistake? Do you still have the original email or are still receiving them?

  • The deal he wanted was tiffins on the park, same price and it was on the 14th feb. If you google scoopon tiffins on the park you will see it. The brisbane one im guessing would have started around the same time the adelaide one ended which is why i wondered whether the link was outdated. Just speculating though.
