Company Wanting Work Done on Road in an Unsafe Manner

Hey guys, I work in an business where we need to access stormwater drains. Some of these drains are found on kerbs, parks, roads and on the kerbs of busy roads.

We have a few pits that are on the kerbs of busy roads. We've been previously instructed to park our Triton behind the pit blocking one lane and putting safety cones to reduce risk. There are times where this feels comfortable if the traffic is quiet.

However, there are times where it is a busy road all day and the company is insistent on us stopping on a lane that clearly says no stopping.

I was wondering what the law is in both VIC and NSW for me to back ourselves in not doing a pit inspection should I find a pit that is not safe.

    This seems to be the norm for road works - whether by private contractors, council workers, or state transport workers; you see this all the time.

  • Worked in similar position in WA. Employer would provide traffic control in situations like this. It really should be factored into the cost of a job.

    there are parking exemptions for road work utility installation and maintenance.
    rule 310, part 12, rule 288, rule 289.

    this may be covered by the sydney water act. check if there are parking exemptions.

  • For NSW:

    Check the RMS traffic control at work sites manual for Nsw. It is avaaible online and recognised as best practice.

    How long are you on the road for? There are different rules for short term and intermittent works.

    Dpepnding on the roads you may also need permission to occupy the lane from the road owner, Council or RMS.

    I’m not sure about Vic.
