Hypothetical Transit Lane Question - 1 Oversized Vehicle, 1 Driver, 2 Obscured Passengers

If 2 passengers are sitting in the middle of an oversized coach and the driver takes a T2 or T3 lane, will the driver still get booked by transit lane cameras for not finding the 2 passengers?

Will this also apply if a truckie takes a T3 lane and there is a passenger visible from the front but an obscure passenger at the back of the cabin?

Question isn't exclusive to NSW. I'm curious if anyone can share their state's law of it too.

  • Most people may count to 3. Count the number of people in the vehicle and use the lanes as permitted.

  • I think it's the number of people inside that counts.

    This reminded me of a big debate on funeral vehicles carrying a coffin with a dead person inside. They want to count the dead person as a person so they could use transit lanes.

      They should stir the situation further by having pregnant women count as two!

  • I am not aware of a Transit Lane camera system used in NSW, though I would be happy to be corrected. There are Bus Lane cameras, Speed Cameras, and Red Light Speed Cameras. I believe a couple of noise cameras are being trialed in NSW also (Mount Ousley and Woolgoolga).

    The bus would be required to be pulled over by Police, who I presume would then notice the passengers in the coach.

    • You are correct - no such thing as a transit lane camera in NSW.

      We have speed cameras, red light cameras, bus lane cameras, T-way cameras, and point-to-point cameras, but no Transit lane cameras.

  • The law's based on how many people are in the vehicle, not how many can be seen from outside.

  • Just have a bunch of clowns in a mini. You can go on T50 lanes like that.

  • Buses, taxis, hire cars, motorcycles, bicycle and emergency vehicles can use transit lanes at any time. So a coach with only the driver on board can use it.

    End of the day it is really an honour system because there probably isn’t a lot of enforcement, but if mr policeman wants to stop you and do a head count you might end up with a fine.
