Hit N Run Claiming Search Fees

Early this week we had a vehicle do property damage and the driver didn't want to hang around to leave details.
It came to my attention a couple of days later when I saw it and have had to ask around to get an approximate day to find on the video footage.
The camera is just off focus from the damage so I didn't have a before and after footage to cross reference with each day so I've spent about 4-5 hours going through till I found them.

I've taken up with the Police they've said we have enough compelling video evidence for insurance to claim against them now we have worked out who they are.

My question is. As a business can we claim for wages time spent search fees to include with the cost of the repairs of the damage to the hitter and runner offerer

  • Your lawyer will need to prove it's a "reasonably foreseeable loss". At least this is how it works for contract law in Property. You can only claim "actual loss"

    I am definitely not a lawyer, but I would assume not? If you didn't have the camera, you wouldn't be able to do anything. You have the camera, but the placement has made it difficult to get good footage. If the camera had been placed differently, you might have had more success in a quicker timeframe. That's not really anything to do with the actual complaint.

    The hit and run is a criminal offence, the damage is the civil claim. There are two different things going on here. Now that you have information to provide to the police and the insurance company, you leave it in their hands.

    I believe you can't claim internal costs but might be able to claim any additional costs the business has to incur.

      So it's probably worth paying someone to do the investigation (so there's actual cost that can be claimed) instead of doing it yourself?

      • Probably not, in case it is hard to get it back.
