Bought a Cheap Gigabyte 2080 off Amazon for $1040. My Order Was Refunded and The Price Has Gone up to $1372 before It Shipped

Bought a 2080 from oztech on Amazon and the money was taken out of my account and a shipping number generated, but a few days later it was refunded and the price of the 2080 was raised.

Do I have any footing to make them honor my purchase for the original price? I think its very shitty of them to do this, even if it was accidentally listed that low.

I noticed this deal was submitted to OzBargain (I don't think it was approved by the mods) so is anyone else in the same boat as me?

    Australian contract law requires an offer and acceptance. You the purchaser made an offer to buy the item at the displayed price. The seller has accepted your offer by taking your money. There is ckearly a contract in place and you have the right to enforce that contract. How you do that and at what cost is another matter.

    Sellers don't have to accept customer's offer to purchase at the stated price but once they do there is a legal obligation on them to complete the contract.

        • Agree; however this is Amazon reseller we are talking about it hasnt been fulfilled.

    • Doesn't quite work like that in the digital age. Acceptance is not considered taking the money since it is an automated process. A confirmation of shipping maybe be enough but it's unlikely you'll get anywhere without going to tribunal/court.

      • More to do with principles of unilateral/mutual mistake.

    • I feel a bit bad this was negged to the point of Disabled User. They're technically right, they just haven't gotten to the part of Contracts Law course that deals with (exceptions to) unilateral mistake.

    Amazon support are generally pretty good. Contact them and see if they can do anything for you.

        I bought a GTX 1080 from an OzB deal last year. The seller couldn't fulfill the order. I complained to Amazon's support and they told me to find another GTX 1080 that they were selling and they'll price-match it to what I'd paid… so I ended up getting a better GPU.

        Won't hurt to try.

    Price errors are price errors. At least you didn’t have to wait weeks and fight with them to get your money returned. Be thankful for that.

    Maybe you should cut your hair short and dye it multi-colours and then demand to speak with the manager.

  • I managed to purchase it as well for $1044. Got shipping notification the next morning and in the afternoon, I got an pretty informal call from oztech saying they made a mistake with the price and it should have been the RTX 2070 not RTX 2080 for $1044 so they're going to refund the money.

    I did an online chat with Amazon the next day and they said it's not fulfilled by them so they're not obligated to ship it but they'll contact the seller about it. They also sent me a $20 voucher.

    All in all, I didn't expect it to go through. It's just another price error, so best to move on and find other bargains :)
