Blocked IMEI Phone Help

Hi all

I purchased a phone from gumtree and after 1 month it has stopped working. I checked with Vodafone and they said telstra has locked the imei. It was genuine purchase and the guy is not willing to give money back to me. Cops said they can not do anything about it.

What can I do :(? I have lost $1100.

      Or sold it, then claimed it was stolen to claim it on insurance and get a new one

    Its obviously not a geniune purchase, Telstra would not lock it unless it has been reported lost/stolen. Not much you can do unless you can go to Telstra with proof of purchase or sell overseas.

    It's been stolen. Or he's done an insurance scam job.

    Have you got anything to show you bought it? Gumtree messages? Facebook messages? Text messages? arranging to meet, negotiation etc? Try and get a cached version of the listing.

    If you can prove you bought it they should be able to unlock it for you.

    • The owner might get some "friend" to sell it. Unless you can proof the person on gumtree is the orginal owner.

  • Long story short. Cops said it is civil matter. Guy's mom called cops on me and I was given trespass notice. Telstra said the owner reported stolen and got new phone. They can not help. Called his insurance but they do not deal with me as I am not a customer. Even when their client is a fraud.

    So I have lost the money and I have fancy device.

    • i heard imei locking is by country only so your phone can still be used (or sold to) overseas.

    • Speak with Telstra fraud department. Provide all correspondence from sale including conversations etc. Not sure if they can unlock it after its been locked though. At least they will cancel his contract and request phone back

      • Nothing they can do really, unless you got a copy of the guy's drivers licence and him writing a stat dec saying that he sold it to you.
        There is 0 way you can prove that the guy who sold it to you is the guy on Gumtree.

        Telstra won't care unless you have clear concise 100% irrefutable proof of the entire case, because from where they stand:
        1. covered by insurance
        2. if they cancel the contract, they lose money

        The unlock process can only be done by the first owner of the phone, only time i saw it done was when the person actually provided a Stat Dec + Drivers Licence which proved the transaction actually occurred.

        Only way to really move forward is either:
        1. Get a lawyer instead of asking OZB

        You could sell the phone, but since you have the knowledge that the phone is stolen, then it is technically illegal to sell it now.
