Is It Misleading and Deceptive Conduct from The Iconic?

I was looking for a dinner suit and came across sale item from the Iconic which they are selling for $129. Apparently the original price is $299 as per their listing.

When I went to the seller's actual site, this suit is listed for $89 which is a normal price.

Am I correct to say that the Iconic is being deceptive and misleading here?

    I can't seem to access the Iconic website (?). But to me it sounds like two different websites offering the same product at two different prices.
    The Iconic pre-sale or post-sale price doesn't need to equal the manufacturers price.

    These are the conditions of false or misleading advertising.

    • The product on Iconic website will also be shipped from Kelly Country.

      My concern is both products are same for same brand, the standard price is $89 but why Iconic will list it for $299 and then make it look like sale item for $129 which is higher than Kelly Country price.

        Got the website working — won't work on my phone for some reason.

        There are two separate businesses with two separate fulfilment processes.
        If Iconic are playing the "middle man" by having their order fulfilled by Kelly Country, this doesn't constitute deceptive conduct.
        To me, it seems that Iconic is just taking a finders fee.

        Despite the fulfilment process, the Iconic pre-sale price doesn't need to equate to Kelly's pricing structure.

    I was able to access both sites - and one doesn't really relate to the other.
    It is not misleading for the same item to be offered for sale at a cheaper price elsewhere.
    For the purposes of your enquiry the real issue is, did the Iconic offer the item for sale at the higher ($299) price shortly before this 'sale'?

  • Bottom line is shop around. Even online. Just because they advertise a sale doesn't mean it's the best price around.
