NSW Windows Safety Rule Rant

I live in an appartment building that is 9 storeys high. Now about about a year, may be two, the NSW government decided to introduce their window safety rule of prohibiting windows from opening more than 12.5cm. I can't take this anymore. Having to not be able to open my window more than 12.5 cm is painful in this hot weather.

Surely people can't be following this rule, at least not in this weather.

    Read https://www.fairtrading.nsw.gov.au/housing-and-property/stra…

    From the FAQ

Will this mean the windows will never be able to open?

No. A window lock that allows the window to be fully opened, fully closed and also locked at less than 12.5cm, complies with the legislation.

    and

Is an owners corporation required to monitor the use of the window safety devices?
An owners corporation is not required to monitor or enforce the use of window safety devices. The strata scheme management laws also does not require that the devices be used at all times.

NSW Fair Trading strongly recommends that window safety devices are used when children are around and on all common access areas, such as stair landings.

    You'll be fine

    • Noice… thanks a heap.

you're not wrong until you got caught.

Stupid saying. You are wrong, even if you don’t get caught. It’s like the saying, “it’s only illegal if I get caught…” no, it’s illegal, fullstop.

What should be said is, “not going to get in the shit if I don’t get caught…”

Not being caught does not magically make something legal/right.

…or a kid falls out the window

Are you sure you're seeing that correctly? My window must have a lock at 12.5cm but thats not the maximum, it just has to be able to lock at that amount if I need it to, I can open it fully if I want to.

I think IceCreamBandit has it as:

No. A window lock that allows the window to be fully opened, fully closed and also locked at less than 12.5cm, complies with the legislation.

  • Sounds like it has been designed to stop kids falling out. Sounds like mesh or bars on windows would be acceptable alternatives as well.

    • Until there’s a fire and you need to get out via the window.

      • 9 stories up? Have a latch with a key so it can be moved.

We have the Doric window locks, the stop the window at 12.5cm but can be removed via a key to open the window fully.

  • "Uhh the government has mandated how far I can open my windows…what on Earth can I do as I am suffering in the heat."

Same thing happens with hot water: 'government' has mandated that we cannot have our hot water over 50c.

The answer to both and many other tyrannical intrusions is simple. DISOBEY!

Careful though, if 'everyone' opens their windows beyond 12.5cm there could be ANARCHY!!!! :)

  • Wow. This is what some people have come to. Not opening there windows past 12cm. We are in big trouble as a race of people

The window option appears to be fully open, fully closed or 12 cm. Don’t have a problem as this offers the option for people to set this window width if the want air but there is a risk of child/pet going out the window. No different to seat belt laces, child seat laws, etc.

  • Is this just another Apple Fanboi rant?
