TRS Claim Then Return Item to Store?

Hi all,

Question
If I purchase several items online right before departure (total up >300aud), claim TRS then realise some of them do not fit/faulty/not to my liking, can I send them back to store for refund?

Will that cause any problem from getting refunded from the store?

    No, but that's technically fraud and do not fit/faulty/not to my liking is not a valid defense.

      Well surely they're entitled to return them if they wanted but need to advise TRS they no longer own the item and should cancel/refund any TRS claim.

      Bringing goods back into Australia for which you have already claimed a TRS refund
      you will need to repay the GST refund back on the goods you claimed under the TRS

        What exactly are you looking to hear from the forum? You are told it is possible, and also told it is illegal. Any other questions?

      • It technically should be ok but I would suggest getting independent legal advise. You are permitted to claim TRS on goods that are over $300 incl GST from a single retailer. You are permitted to bring in $900 worth of goods so if the claim is under $900 there should not be an issue and you should not need to declare it. If it is over $900, you may also claim the purchase has depreciated.

  • If you claim TRS, you're declaring the goods are not returning to the country and you're getting after sales tax partially "reimbursed".

    Your scenario would make this fraud for two reasons.
    1. The goods returned to the country. Excuses does not change that fact.
    2. You're getting monetarily reimbursed for something you didn't buy.
