Car Park Accident (Was It Really My Fault?)

I had reversed on the car park road to let a car get out, then another lady decided to pull out of the car park and she hit my car. Few scratches on the back side of my car but a dint and small scratch on the centre back of her car.

She went off and said it’s my fault and she’s putting in a claim.

Was it really my fault? How will insurance handle this?

    If she hit you whilst you were stationary, then she is at fault. MS Paint diagram would help though.

    This sounds like you were reversing and hit the side of her vehicle.

        • The back as in the rear of her vehicle? Were you both reversing at the time of the collision?

            @whooah1979: The only thing I can think of is that OP was looking for a space. OP sees Car 1 about to leave a space and reverses to allow this. At the same time, Car 2 who is also leaving a space begins reversing out from behind the OP. OP's car and Car 2 collide back to back.

            However OP is not making things abundantly clear.

            If I am correct in my way of thinking, and if OP has damage to the rear and side of their car, whereas Car 2 only has damage to the rear of the car — that would imply that OP's car was behind Car 2 when they begun reversing, which would put Car 2 at greater fault than the OP. However this is on the assumption that both cars were being operated safely, without the OP or Car 2 reversing at pace.

              • @Jumpup: Considering how some people were confused about how the accident occurred based on your description, you better make sure you describe it more clearly to your/their insurance, so you don't incriminate yourself.

  • The insurance co will ask why the damage is to the side of her car when you claim she backed into you.
    What will you say?

    • The damage is at the back of her car only

  • Any photos or footage? Very hard to speculate on words alone. Images would probably allow a decision in seconds for the insurance company.

    Without video footage, this is how the insurer will assess it.

    You are on the road. Driver2 is parked.

    Your damage is to the rear corner/side towards the rear. Driver2 has damage to centre rear.

    All other information is irrelevant unless provable.

    It is Driver2's fault because:
    1. They reversed into you. The damage demonstrates this.
    2. They had to give way to cars already on the road. They were parked. You were on the road.
