Scoopon-Mosskito Restaurant Not Hounoring Voucher

Went to Moskitto restaurant saturaday, wife called in February and booked a table for Mid May and the rude indian guy and his mate the owner refused to honour the vouchers they reckon we didnt tell them, we booked with the vouchers and threw them back at her adn refused to accept or speak to us any further unless we paid the full amount and said hell call the police i told him to call, adn wouldnt even look at us so we left, and got a call from the cops yesterday. well be sorting it out Thursday but in the meantime scoopon hasnt contacted us on the matter.
We made the booking with the vouchers, and rescheduled for another day cauue my wife and son sick in may, now they say also we only allow a certain amount of scoopons per day, as far as i see we broke no terms or conditions listed on the website, i should sue these guys for stress, does anyone know what i can do about this?

    Good grief. Good luck with that. Keep us updated. I think you are in the right. They shouldn't have rescheduled you if they weren't going to take the scoopon.

    There would have to be an intent to defraud or gain goods without paying. So you have no worries with the cops.

    If anything, some of these restaurants should be charged with theft………………..

  • Scoopon - what are you going to do about this restaurant? I assume you will give hunter a refund and other than that, do nothing other than say "we have spoken to the restaurant blah blah blah"

    REfund? I broke no terms and condiions as stated on the website, if the restaurant has other specific requirements they should clearly state them, and tell people over the phone when they book, or even before they buy the vouchers like we did and still this crap happened, there was no mention of allowing a certain number of scoopons per day or you will be forced to pay amount in cash and lose $80 in vouchers, its fraudulent and misleading and bullying and being rude like that to a woman is very disrespectful the rudeness was so unbeleivable ive never seen anything like it.

      Hi, have you contacted police? i can give you the name of the constable if you dont already know, but she isnt working till thursday morning. whats the progress on this matter so far. I assume yuo got the restaurants story, please let me know what they have said.

      • I wouldn't have thought it is a police matter but rather a civil matter. That is a scary story though. Good on you for walking out. Also amazed that you called in February to make a reservation in May!

        • i thought it would be a civil matter also, we bought the vouchers in Feb, when my wife saw them advertised she thought she would make a booing for her brithday. Planning ahead.

        • Technically it is a criminal matter - the crime is obtaining property by deception. The deception arises because when you sit at a table and order, it is implied that you are going to pay.

          Having said that, clearly there was no deception in this case as payment had already been made through the purchase of the Scoopons. Really hope this is sorted out, has certainly changed my opinion of Mosskito.

          Gooch you are right, when you go order and then just leave its a different story, in my case its not criminal, i already payed for the vouchers and tried to pay the difference at the end which was toatally refused unless full amount was payed,
          anyway cops have said its not a police matter its a civil matter since im not the one trying to decieve, i should have him charged for deception trying to chabge the terms and conditions as they go. he had my phone number he could have called me instead of putiing me through this.

  • that's terrible, i've always thought the place was very good with the vouchers. as went with over 10 work mates for lunch last year and they were happy to accept 7 odd vouchers when paying.

  • I went a month ago and the staff was very friendly.. I also have a few Entertainment Book vouchers that I'm planning to give to my friend to use for their birthday. I called up and asked if I could use a few in one bill and they seemed absolutely fine with it. Don't know how much difference there is with a Scoopon VS Entertainment Book vouchers.

    • Think they are getting less money out of the scoopon vouchers compared to entertainment book vouchers.

      Entertainment book vouchers, with buy one get one free, they still get the $30 or so and give $60 worth of food… (I don't know what the value is with Scoopon) … but Scoopon is probably something like $30 for $70 value and they get $15 but have to give $70 worth of food, because Scoopon gets a cut.

    We had Scoopon vouchers for Mosskito all you can eat, drink, breakfast lunch and dinner for $100.00, we paid $39 for each voucher. I told them that I had 2 vouchers when I rang them up and they said it was ok just bring them in on the night. I rang a few days earlier to rebook as my son and I were both sick and they didnt mention the vouchers and I thought they knew about it from the original booking.

    When it came to pay our bill it came to $228.00, and I gave them $30.00 cash and the vouchers and they became so rude, the Indian man behind the counter was so rude and said he refuses to honour the voucher as there was no scoopon booking!! omg there was no way I was going to be bullied into paying, I did the right thing and the manager OMG he was the rudest man I have ever had the misfortune to deal with!! I have never ever been treated so badly in my life, I was holding my 1 year old son and it was freezing cold, waiting for them to sort it out and they were just ignoring me and serving other customers. The Indian man said he was ging to call the police if I dont pay the $200 and I said go right ahead and I will wait for the police, I was waiting and waiting, my little boy started getting restless and it was cold, I tried one more time to resolve the issue, gave them the vouchers and money and he threw them back at me and gave me the most dirtiest look ever!! I couldn't wait any longer so we left.

    A couple of days later we got a call from the police, I wasn't home at the time so I called back and the Constable in charge wont be their until this Thursday, so I am stressing out at what is going to happen, I am a stay at home mum trying to look after my son and I have this to worry about.

    There is no way I am going to let these people bully me into paying for something I dont have to!! I paid $70 for 2 vouchers and I have every right to have those vouchers honoured. I did the right thing and these nasty people want to get away with not honoring them, I dont think so!

    BEWARE OF MOSSKITO RESTAURANT!! They will do anything not to honor the vouchers. There food was nasty and the staff so arogant, they stuck us on the table and left us there, we had to call out to them for drinks etc!!

    The food was so bad, my husband thought he was eating lamb and chicken souvlaki but the lamb was either going off because it tasted like liver!! YUK the spaghetti and lasagna was the ones you get from the frozen section in Safetway and banana split was the worst I have ever tasted!! The pancakes omg my little niece was dry retching when she tasted it, it was raw!!

    I have never ever been treated so mean and dealt with people that are so rude and arrogant in all my life!!

      It is outrageous, to be sure. Be sure you tell your experience on both Urbanspoon and True Local.

      You don't even have to be a member of urbanspoon to vote "don't like it".

      You have everyone's support here Mary. You really shouldn't have anything to worry about. You did everything by the book and followed all the terms and conditions. Mosskito will have had several complaints to even further back your case.

      Also just to disclose, are you and hunter the same or related?

      By not accepting the $200 worth of vouchers (which to me it looks like you should have been able to), I imagine it has cost the business a lot more than $200 in bad publicity.

      I hope Scoopon are on this as a #1 priority and the case has been escalated to management. Paying hard earned money for a voucher and having the police called on you is just unbelievable.

      It is situations like these where Scoopon needs to have a phone number.

          Yea the restaurant owner has made a big mistake on this i can assure youm im not some pathetic weakling to bully around into paying for it when legally i dont have to. He seems to think my business is insignificant to the amount of people that go through there, well see after this week, ill keep you posted.

          Scoopon seem to have made it a number one priority to resolve this and have been very helpful, they do have a number for when cases like this arise. Ill wait there call today when they have fully fixed this matter.

    I saw on Scoopon they sold 1300 vouchers to Mosskito!! Imagine how many people they are ripping off!!

    The poster paid instead of leaving. Seems to be a bit of a pattern here.

    I bought one for a Cafe in Melbourne called Mosskito at Clifton Hill and another for a Greek restaurant on Chapel St called Mamacas. I'm from Adelaide but was coming to Melbourne for the easter weekend. Rang and booked at both places weeks ago with both places knowing it was the Easter weekend. Got a call from Mosskito 2 days before Easter weekend saying they weren't accepting scoopons any days over the easter weekend and that the staff member shouldnt of taken my booking and perhaps I would like to book in for another weekend. After telling the lady I wasnt from melbourne and that the only day stated that it couldnt be used on the deal was mothers day she said they would honour it. We rocked up for the lunch on Good Friday and showed the waiter the voucher as soon as we arrived to which he said "that's fine just show it when you leave". Come time to leave we handed the voucher over to the waiter who disappeared and the owner (and one of the most arrogant men I've ever had the misfortune of dealing with) appeared and flatly refused to accept the voucher. Another waitress tried to back my story that one of his employees had spoken with me on the phone and said it would be honoured but he promptky shot her down too. The scene became very embarassing as he would neither listen nor be reasonable and we stupidly paid the bill for $110.70. In hindsight we should of just given him the $10.70 which was all that should of been owed as the voucher was for $100 worth of food & beverages. My main argument is not only the disgraceful way we were treated but that the waiter who served us and seated us knew it was going to be a problem but never mentioned it so we never got the option of walking out without ordering.

    Thankyou for that and Yes ive already seen this seen this, i can tell you theres been many complains about them and realistically this guy should have walked out just like i did. Keep an eye on channel 7, they have been investigating this restaurant for a while now!! Can't say too much, but hopefully they wont get away with ripping people off anymore!!

    Update, i still dont know whta Mosskito have said so far in this matter to police or to Scoopon, only that there was a mis - communication problem, and now the owner denies being there.
    Anyway Scoopon have rectified the matter, they have promised a refund for the vouchers and sent us a gift hamper.
    Also they have paid the bill for Mosskito, which is no fair they shouldnt pay for something the restaurant should be onouring.
    Also police contacted us and said it wasnt a problem and that theres nothing they could to its a civil matter regarding the voucher ordeal.
    Plus this was aslso rectified very quick i assume becasue Channel 7 got involved, becasue police were called on us for doing nothing wrong and standing our ground.
    so i suggest to others out there if someone wont accpet the vouchr then walkout. thanks for the kind wishes from everyne.

    • It's good that you guys actually did something about it (going to Channel 7) rather than simply complaining on the forum. As a result, it looks like you came out the winner (and rightly so). Businesses shouldn't be allowed to get off treating people like this. Well done.

    I'm wondering why Scoopon would have to pay the restaurant? Surely they would have something to say that if the restaurant didn't honour the voucher, Scoopon shouldn't have to pay them either?

    The more I think about it the more I start thinking, that Scoopon in a way is saying that I'm in the wrong and thats why they are paying the restaurant, I find it weird also, that Scoopon has not told me what the restaurant is saying!! All abit weird to me the more I think about it!! The restaurant should have honoured the voucher, its like they are double dipping, getting the money for the voucher and the $200!!

    • Do we really know that scoopon paid the restaurant? Are you taking Scoopon's word for it?

      • I was told via email and by phone, and Scoopon aslo told police they are paying it, my wife called them herself. Nothing else will arise from this, but as i said before i dont know what story teh restaurant gave and if scoopon really paid for it i dont know.

    Nah, if Scoopon thought you were wrong, they wouldn't have refunded you would they? These forums are full of horror stories of Scoopon not refunding without a fight…

    I guess whatever was agreed between the restaurant and Scoopon is between them - I'm really curious too though!

    Omg that is such a similiar story to what happened to my Grandma!!

    Went there with Scoopon vouchers and I have never seen such rudness in all my life, the first thing the waiter said do you have scoopon vouchers and then just stuck us on a table that wasn't properly wiped down!! Compared to the other people's food ours was small in comparisn and cold, I'm assuming that was because of the vouchers!! The waiter forgot about us, my grandmother had to keep on asking him for water!! The Indian cashier just snatched the voucher from my grandmother so rudely and didnt even want to talk to us, just took our money and walked away!! My poor grandma was so shocked in all her 80 years she said she has never ever seen such rudeness in all her life

    Good on you for sticking to your guns!! Regardless they should have honoured the vouchers, I can't believe they called the police, that is so bad!! The owner of the restaurant should be ashamed of himself and he needs to take a look at the staff he has working for him. I dont think he cares that they are rude, all he wants is money.

    I read many a story regarding this sort of thing with the group buys and it really gets my goat. Don't participate if you don't honour the deal. My mate just bought one for another restaurant and they better be good with the voucher. You shouldn't be made to feel like a cheat or scum for using - after all, the restaurant willingly participated

  • Your story sounds insane I would have been too embarrassed to fight for my rights when someone is yelling at me. I would have complained to scoopon later and taken my battle in a more admin manner. Wow… I always get screwed when I don't show vouchers or deals at the start or enquire prices so as to not look cheap (once in 100 times). Recently rock lobster screwed me over with a deal like this. Oh well… I guess no more group buy restaurants.

    The only one I loved and may buy again…but am worried to buy cos they sell so many is Indya Bistro. I am indian and I liked the western touch the chef put on and the lovely masterchef decorations on place…mm… a bit slow on the service but I would go back.

      From experience it seems these places seen to offer these deals regularly knowing fully well they will try not to honour vouchers or whatever they do. The customer pays them for the voucher, why do they do that to customers if they dont want to know about it when it comes time to hom=nour the deal?
      Look we are both calm people and dont like confrontation, but this situation pushed us to the limit where enough is enough of people trying to scam you and bully, intimidate and force you to back down, and it was time to not back down and fight for my rights.
      Some business owners are ruthless caniving dodgy pricks, and have been all their lives thats why they become successful ignorant arrogant rude people who dont care about anything other than money, and if they see a sign of weekness they go for it and try take you down.
      Why you think there are so many people getting shafted over these vouchers?
      To take your money and provide no service for it, and the law makes it hard to fight for your right to get your money back, its simply not worth the hassle to go to court for such a small amount of money, and they know that and they always get away with it

      • Nuh fair enough. I guess it depends…as a tiny little female, I try not to get into many fights with strangers specially since you can't anticipate what they will do. However the news idea sounds great.

        And thing is I guess most of these places don't expect you to redeem vouchers. I heard a statistic on TV saying 60% of vouchers are not redeemed. Go figure. Maybe scoopon should give money to these businesses as the scoopons are redeemed rather then all at once at the start and then at the end if no one has claimed that money belongs to the business. Atleast gives the business motivation to serve you well, if anything goes wrong scoopon can take it out of the rest of the money.

        Firstly, well done Hunter and Mary. I agree that something should be done about this whole restaurant voucher issue. My Scoopon problems have been with over-subscribed restaurants with limited opening days = no vacancies - which then equals no refund as they are sold subject to availability. These discount companies should limit the number of vouchers sold, and be more explicit in their terms, for each individual restaurant.

        • i guess the only way is to call the restaurant ad ask beforehand if you dont like what they say dont buy the vouchers. we did that but we still got shafted, just have to be carful.

  • This seems to be happening far too often with scoopon. If restaurants will only accept a certain amount per day, they should state that up front before people shell out their cash

      The same is true with these beauty services. They should only sell enough to where people should have a reasonable expectation of getting in within 6 weeks. I have had to book things 10 -11 months out for a weekday booking. AND you end up getting crap service. TT or ACA should do an expose on these companies. I nominate No 4 Claremont or Charisma in WA.

      • TT is a channel 7 show. Spreets is owned by Yahoo7!
        ACA is a NINE show. Cudo is owned by Nine/Ninemsn.

        Companies pay to appear on those shows. I don't think you will see a bad story on group buy sites. What's bad for Scoopon is bad for the rest of the related companies.

    On the plus side we had a scoopon voucher for Shocolate in Brunswick, a chocolate degustation for 2!! We had the best time there!! The staff were so friendly and the chocolate so yummy, I had the best vanilla bean icecream I have ever tasted :) It was such a good feeling when you go to a place and everyone is so nice to you, and we will definately be back there again!
