NSW Unregistered Car: Going to Court

Hello Everyone

Offence:

  • I was driving someones car which was 2 weeks unregistered, when pulled over
  • I registered it online 6 months ago. I should have done it 12 months by mistake I selected 6 months. The CTP was paid for 12 months.
  • When the Cop went to check my license, I logged online using my iPhone and renew the rego. Still, as the offence was made, I received $673 fine

My Effort:

  • I wrote to Revenue NSW, "I have no traffic offence for over 10 years and its genuinely an honest mistake"
  • Revenue NSW (former Office of State Debt Recovery) replied:

"We also consulted the Caution/Review Guidelines, legislation and information provided by the issuing authority. Our investigations conclude the penalty still applies."

Question: If I go to the Court and plead guilty and the penalty stays, will I receive additional fine?

I received the RMS reminder notice the following days, irony of fate!

    673 is cheap for driving unregistered

    if you hit someone, you'll get sued for millions till bankrupt

    in qld driving unrego = upto 5k fines / suspension / jail time

    Good thing you paid 12 months for CTP, because you would have been booked for being unregistered AND being uninsured. So you got off with the only offence that the police officer was entitled to book you for (no rego).

    Why do you give them the opportunity to generate revenue over a simple admin problem?
    I mean paying rego for 6 months is blatantly obvious on the pocket considering its exorbitant charge, so you should of flagged this when you have seen your statement.
    The good ol' days, you would get a post rego-slip and then go to the bank and pay .. and would have noticed an issue then and there.
    Now, with cost cutting automation and DIY handball so they can save more cash. Hopefully you can now forget and get nabbed considering there is no sticker affixed on your windscreen.
    They want your money and don't care about your circumstances. You will get zero back.

    Speeding or running a red light, isn't the same as not paying registration, so your "10 year record" means squat

    How did you manage to get 6 months of rego when you had 12 months of CTPI? Whenever I've renewed my rego, it would only let me do it for the same period as the CTPI. This checks out with the RMS website.

    To take advantage of short-term rego, your CTP insurance (green slip) and registration period must match.

    If what you say is true, then you may have a chance of disputing it on the grounds that according to the guidance of the RMS, you shouldn't be able to renew your rego for a period shorter than your CTPI - however I suspect that you didn't in fact have CTPI at all.

    • I have the CTP valid , hence I managed to renew using the Service NSW APP

      • Well if the CTP policy you had was valid for the 12 months, and can be confirmed as such - you may stand a chance if you use the line that you were under the impression that both the CTP and Rego were in alignment. Given that their system usually wouldn't allow you to renew them out of sync, then you might be able to argue that point.

        If you had renewed the CTP since it had expired, and not the rego, then I think you've got no chance

    It's interesting that the driver bears the responsibility in these cases. Since they abolished rego stickers, there's no instant (I don't think it's reasonable to expect a driver to go online and check every time they drive a friends car) way for a driver to check whether a car is registered.

    Are you allowed to nominate another driver in these cases?

    There's no leniency for "honest mistake" either by writing a letter or going to court. You might get lucky and find a sympathetic judge to imposes a lower penalty, but I think it's unlikely.

    In reality it wasn't an honest mistake - you would've ignored the reminder notices too.

    • This is an interesting point. If I borrow a friend's car to drive & they tell me it's registered, who is at fault if it really isn't registered?

    Question: If I decided to go to court,
    (1) Is there any possibility to get a good behaviour bond/ plead guilty and get the waiver?
    (2) Can court increase my fine if unsuccessful?

    (1) Maybe…get a reduced fine.
    (2) Probably won't do that.

    My unasked advice - Pay the fine, avoid court.

    Where is the mandatory MS paint diagram? You should've at least drawn a car skeleton with no plates so we could know what exactly happened - Perhaps write "Wife's car" on the side so it's her fault not yours.

    Probably best option is a guilty plea with mitigating circumstances

    if you fight and lose the court can charge you the maximum for the offence

  • God knows why anyone would want to go through the hassle of going to court for $6-700 and most likely end up in a worse position.

    Something about this story doesnt quite stack up.

    Go see a lawyer who specialises in traffic law if you want advice…

    Just pay the damn fine and learn your lesson. I know it sucks and was unfortunate but at the end of the day, it is valid.

    I remember reading a story about a tradie who T-boned a car when his car was out of rego by one day. He actually knew it was overdue but was planning on getting done that week. The person whose car he wrecked ended up with life-altering problems. He was hit with huge medical expenses which he couldn't afford to pay. He declared bankrupcty, lost his job, his girlfriend and many of his friends and family shunned him. He never got over it and took to alcohol and ended up as a recluse. I read this story 15 years ago and it has always served as a reminder to pay my rego on time. True story.
