Out of Warranty Claim ALDI 55" TV

Hello All,

In Nov 2017, I bought an Aldi 55" TV, just recently it stopped working.

I was expecting to live longer than this.

I called Tempo to try to get it fixed under the warranty as it's just out by 7 months, but I was told they would only cover parts and not labour.

Do I have case with the department of fair trading (NSW) as I think 1.5 years is not reasonable expectation.

Update:. After second escalation, Tempo/Also have agreed to fix the TV at no cost to me. I think it was the fact that i mentioned OzBargain.

    Yeah throw Australian consumer law at them. You would expect a brand new TV to last longer than 2 years.
    If they dont abide then you send them a letter of demand - if they still dont do anything then you escalate to ACCC.

    I once had a macbook that was just under 2 years old, fried, they said that it'd cost +$1000 to fix it, I threw Australian Consumer Law at them, fixed for free no worries.

      this only works if the business is willing to play ball. if they just say "no", there's very little you can do without going to court.

        They often assume that you dont know about Australian Consumer Law, once you bring up the fact that an item should last for a 'reasonable amount of time', they usually back down and give you what you want.

        accc will slap a big fine on them if you stand a ground, no need you to sue

          ACCC is a toothless tiger. it's only when a large amount of complaints are received and it's without doubt a travesty that they get involved. so i don't think they will get involved here.

          a lot of businesses do the right thing when consumer law is mentioned politely, i'm not sure Aldi is one of them beyond standard warranty considering they make you ship stuff yourself in warranty claims AFAIK.

      • Hi,the business has nothing to do with the CONSUMERS WARRANTY,there is a expected life on any item you purchase,the last time I searched I think a tv was around 7 yrs

          There's no set timeframe for products under the ACL - it's a "reasonable expectation" test which depends on each individual product sold depending on price, features, etc.

      g'day,contact them first and and if no satisfaction ask about the CONSUMERS WARRANTY, they decide how long any electrical should last,
      I used it on a vehicle that was under $3000 and under $3000 there was no guarantee warranty,but everything you purchase has a life expentancy and when I asked about the CONSUMERS WARRANTY he returned my email and asked how much I wanted,I told him $600 and it was back in my bank the next day.

    Have you talked to ALDI directly? Your rights under Australian Consumer Law are against the retailer first - the manufacturer's warranty is only what it says it is.

    • I've spoken to Tempo who handles the warranties. They will only cover parts, but I want them to cover all.

      During my second call, I had mentioned to them about reasonable expectation, they have escalated again.

      Waiting to hear from them again.

      • No harm in chasing down with Aldi too, your consumer rights re: them as seller exists alongside Tempo’s warranty as manufacturer.

        Sorry - you should be contacting the ALDI you bought it from, not Tempo. Your ACL rights are against the retailer, not against the manufacturer (except in very specific circumstances).

        • For repairs and spare parts, it is ultimately the manufacturer who is accountable. The retailer is accountable for a written warranty.

    I bought a cot from ALDI a few years ago, and it broke so I called the support number on the instruction manual. It was answered by a kid who said his dad would call me back… To be fair, he did call me back, and he told me to take it back to ALDI for a refund

      Who doesn't put their kid to work to save a dollar? This is OzBargain after all.

    How addicted to TV are you?

    • I must admit, I'm addicted to free to air TV which I'm starting to treat, but I like to sit down with my Mrs, and watch our favourite youtube content on the bigger screen. Laptop/Table/Phones are not the same.

  • After second escalation, Tempo/Aldi agreed to fix at no cost. I think it was the fact that I mentioned OzBargain. :D
