Car Accident - Need Advice (Have Third Party Only Insurance)

HI,

Need a advice how to deal and what will be my option here. Got in the car accident this morning. Other driver turned right from left only lane so I hit her car on her driver side door. My headlight is damaged in left passenger side and the bumper is slightly damaged as well. While turning I saw her car turning right as well but I thought that she will stop to let me go but she turn as her right of way and then this happens.

After the accident she was screaming that why I didn't stop or why I didn't let her go first, so I call police and they just told to exchange the details which we did. After I reach my work I call my insurance company and as I have 3rd party insurance only they told that the other driver needs to make a claim and the give me the claim number or they can repair it privately.

I send a text message 2 times but haven't got any reply.

So what should I do here if she don't reply me. Do I have to repair by myself or is there any other options.

Update: I have called them again today and they asked me to launch a claim which I did and now I have to wait 2 days for them to come back to me. At this time they told me that as I am not at fault so I don't have to pay excess to repair my car.They also told me that the other driver have also launched a claim and they gave me their claim number as well. Now will see what will happen next. Thanks everyone for all your suggestion. Will keep you guys updated.         OP explains it differently but he kind of lived the dream of someone breaking a road rule in front of you and instead of hitting the brakes you drive straight into them! If you didn’t know the other driver had just flagrantly broken the law on the turn you’d say OP was 100% at fault.

        • And you've explained it differently than the video as well. The other car stopped to allow another car past. Braked quickly as OP proceeded as well. OP would have seen the red lights light up and proceed only for the other car to proceed to. Hardly OP's fault here.

        Agree no chance of going to court and I agree with your other comment that the insurance company would invest little to no time on this. In making their internal assessment though they need to approximate the decision process a court would take.

        From the removed video we obviously have differing opinions on how liable OP is. But if NRMA agrees with me then those dot points give OP an understanding of the rationale of why NRMA could say he was partially liable for the accident.

    Feel sorry for you OP, OzBargain has a tendency of picking on the OP even though they're not at fault. I hope you are adequately compensated for your troubles.

  • I've never heard of the insurance company saying the other party has to make a claim. Especially since if it's their fault.
    Do you have their License and address information? That's always been the info they ask for when you're third party.

    Call them again, speak to a supervisor and tell them their at fault, your car is insured for their mistake, give them their details and they need to get the money from them.

    If somehow they say no. At least it looks like you won't have to pay to fix their car.

        I have my cheap daily on 3rd party insurance. But that's because I know if anything happened to it and I'm not covered, with the money I saved from not paying for comprehensive over the years, I can use towards a much better car 😆

  • The audacity.. to turn right in a left-only turning lane and then blame you for it. It's not your responsibility to let her go first. She turned right illegally. You did everything right.

      • @Spackbace Actually for my last post there were many comments regarding my video. I just want them to see what really happens everyday here in same road.

  • Whilst I also look out for bargains (why else would I be here), I honestly think legal advice is one of those things you don't go bargain hunting for but YMMV. Some of the ideas on here are illegal/weird/inadvisable. Best of luck to you.
