Salon Sold Me Fake Hair Product - What to Do?

So I went to a new hair salon for a haircut which I liked and they upsold me on a "Suavecito Hair Pomade" which I bought because I was out of hair product anyway.

The first red flag was the label/packaging of the container. The colour looked worn and the label was not aligned correctly.

I contacted "Suavecito" with pictures of the product and surprise surprise - they confirmed it was a counterfeit product.

I went back to the salon about 3-4 weeks later for another haircut with my receipt and the pomade (unused) and requested a refund which they denied. I explained that it was a fake and that it could damage my hair but they acted as if they were unaware. I know that they knew it was a counterfeit product because they spoke in their own language which I could partially understand and they looked very suspicious when I confronted them about it.

I'm wondering what my rights are and what else I can do. I've already contacted the ACCC and written a complaint letter. It was a $25 product which I'd like to get my money back but more importantly I don't want anyone else possibly damaging their hair (or worse losing their hair) because of this fake product.

TLDR: Salon sold me fake product, won't give me a refund, have contacted ACCC, what to do next?

    For what it's worth, the salon was a Chinese hair salon and the product was a fake that was made in China. I normally go to a Korean salon where I have no issues but my hairdresser is on maternity leave.

      I believed your story until I read this. There is no way the Chinese or China would dabble in counterfeit goods. You must be mistaken.

    Given you have already reported this to the ACCC and given this is for a $25 hair product, I would put it behind you for the moment and move on. If you feel passionate enough, follow up the ACCC report and ensure it is being actioned.

    I appreciate that being scammed sucks and selling counterfeit products is scummy — but it's probably not worth losing much more sleep over $25.

        Them not knowing fake products when they're supposed to be experts…Well that's either embarrassing or stupid

  • The ACCC won't be interested.

    You might get some love from your Fair Trading department.

    You could always go for a police report on counterfeit products.

    Not sure you'll see your $25 again without a fair bit of effort.

    I would leave a negative online Google review.

    Further to this, you should generally post positive reviews when you can and build up a history so that when you do have a negative review, it bears even more weight.

    Did you pay on credit card?
    Do a chargeback.

        Surcharge is potentially unlawful so you could report them for that. I'm pretty sure that now merchants can only surcharge the customer the same amount they are being charged by the financial institution. So if they're surcharging more then 1% of the transaction total it's probably illegal.

    Follow up with Suavecito

    They are the ones who can take legal action as the owner of the copyright.

    They can sue for damages and probably wont accept the standard shoulder shrug answer.

    (Although I could laugh when a self declared fare evader talks of rights….😀)
