Cancellation of Contract for Fixed Wireless Service Where Not Offered at New Premises

I don't think I have a case but just wanted an opinion from someone else.

I signed up to Uniti Wireless 14 months ago on their Fixed Wireless network on a 24 month contract and I pay $44.95/month. I've sold my apartment and I'm moving to a location where they cannot service Fixed Wireless.
I have been told that I can either pay a $500 cancellation fee or sign up to one of their NBN plans. The cheapest NBN plan I can sign up to is $69.95/month.

As per their terms and conditions "Where I am able to relocate to a new property which can receive a Uniti Service, and I agree to a new contract term which is equal to or longer than my original contract, and is a minimum of 12 months, then Uniti will waive any applicable Cancellation Fees arising from me terminating the previous contract".

Obviously they're going down the path that I can receive a Uniti Service (being NBN) so therefore I must sign up to a new 12 month contract or pay the $500 cancellation fee.

Wondering if I have a leg to stand on due to the difference in price and no cheaper options available?

Aware that I signed a 24 month contract, unfortunately I need to move to somewhere that they don't have Fixed Wireless.

    If you have 10 months left, you'd be better off just paying it month-by-month rather than the $500 cancellation fee.

    10*44.95=449.50

    I'd just sign up to NBN. I presume you're going to get internet anyway.

    • Yeh I'll probably end up signing on with Uniti for NBN however I'd like to get away from them as there's obviously better sign up deals (free months/upgrades/no-contract offers etc).

  • I think you have no leverage. I would beg nicely for a discount on the NBN. I think there are no threats in this case.

    Not their fault you moved. I'd take their NBN plan - works out cheaper than the cancellation fee.

  • I think they're being unreasonable.

    There's no downside in trying to avoid the exit charge.

    Complain angrily and if they refuse to respond appropriately then escalate the complaint to the TIO.

    The worst that'll happen is that you might not succeed. But, you might win and save $500.
