Claiming TRS on Laptop in your Business if You're Not Paying GST

If you have a small solo-business (pty ltd) generating let's say 15k/year and want to buy a laptop on the way on an overseas trip.

Can you claim the 10% GST back in TRS at the airport and is it done under your personal name or the business?

Comments

  • Why did you pay GST on it if you bought it under a business?

    • +1

merchants still need to charge the GST to customers and it's up to the purchaser to claim back the GST if they are entitled to.

      • You also must be registered for GST to claim it back, meaning you have to charge GST to your customers. OP has stated they are not registered for GST

  • Wait, why are you using a Private Limited Company Structure instead of a Sole Trader?

    • It's a growing product business

      • I see. From what I can remember, the last time I claimed TRS there was no option asking whether you are applying as a business or for personal reasons.

        • Thank you

        • I see. Thank yu

      • Tegrity farms?

  • Buying it for a business I presume the laptop is coming back to aus, so technically u can't if that's the case. (but no doubt u already know that)

Secondly I suppose it depends on what the invoice says. I'm not entirely sure but I believe you can only claim gst if in your name

If the invoice is in your company name u should claim the gst through your bas

    • I see. Although I'm not earning enough to have a BAS/GST

      • +2

If its under 1k and it doesn't have any name on it I'm sure u could get it thru trs. Just don't complicate things and mention business

(again, talking about could not should)

  • People have been doing this for quite a while. Yes, you are entitled to claim back GST and you do not necessarily require to declare it back when entering Australia. GST on imports is only charged if the items value is $900 or above. You can essentially claim the items have already depreciated in value. i.e. laptop is $1000, you could suggest the depreciated re-sale value is now $899 due to the item being used. TRS is for both travellers and Australian's.

  • Ask the retailer to issue a tax invoice as:

    John Doe
    C/- company Pty Ltd
    1 the st
    Sydney nsw 2000

    • Then can I claim TRS on this personally, or does it have to go through the business?

      • Claim under John Doe.

  • be aware you'll be asked if you're re-entering the country with it.

Note sure what it being a business expense has to do with it ;)

btw, you cant double tip the tax.
