Job Police Checks and Courts

Hi,
asking for a friend who's concern, so she's working in aged care for years now and her job requires yearly police checks.
Last year shes gone to court for stealing which was valued $50 sued by her ex etc.long story.
But shes concerned now abt losing her job for this, just wanted to check this for her as she's concerned about this that nihjt lose her job

  • Simple answer, if she didn't do it they didn't charge her. If she did she doesn't deserve a job with the vulnerable.

    • She did, she took a house belonging for their house and her ex sued her and she went to court and admit taking it

            @newbiesh: Lol did she get charged? If the goods belonged to her I don't see them charging her.

            Not on a teddy anyway. Bad decision on the statue.

              • @newbiesh: Yeh that's civil not criminal, if the ex took her to the police first that would be an issue

                Also statue must be worth more or he's nasty as court is more than $50

        This sounds like a civil lawsuit. There won't be a criminal record.

    My advice would be that she speaks with management now, explaining her situation and her worries about the police check.
    If she's been a great reliable employee in the long term, they may overlook this small incident.

  • Go back to court and clear her name? And/Or talk to the management as @olivecheese suggest.

        If only that, then there's no criminal matter and no criminal record.

        Also, since it was civil and not criminal, tell her to stop saying it was stealing and instead just a "disagreement over belongings from a relationship".

    I dont know how many times i read similar things "Asking for a friend",are people too scared to ask for themselves or is it really the culprit who post this crap?

    Only criminal record offences will be on the police check. And I think only after they have resulted in a conviction (so if you are a murderer awaiting trial it will still be clear).

      Pending matters appear on police checks, so a person charged with murder that isn't finalised would still appear.

  • Even if it is recorded, the organisation still has the discretion to employ depending on what is listed.

    It should also be a check every 3 years, not every year?
