[Resolved] Appealing Victoria Police Fine in Court

Anybody done this and can tell me what's involved?

Background as follows:
I turned onto a two lane road. The right hand lane had a red light, the left lane had a green light for turning left or going straight. I had to turn onto the right lane as there was a queue of traffic in the left lane. I reached the lights and after all traffic in the left lane progressed I proceeded straight from the right hand lane indicating left and proceeding straight . No dramas, didn't cross into any oncoming traffic etc and didn't turn right.

Received a fine for over $400, appealed the fine and had the appeal rejected. Wondering if ther eis any point trying to go further as I can't see how I was any danger to anybody in any way. It was a camera that clocked me.

    Irrelevant. If you run a red, after stopping, at 3am, after looking both ways, you'll still cop a ticket.

    Sounds like you're justifying to yourself that there was no perceived danger. Illegal is illegal.

    Don't waste your or the courts time and/or money on this - just see it as a learning experience to obey the road rules. If all motorists started disobeying road rules based on their perceived risk/danger of the situation, then we'd potentially end up in traffic chaos.

    If you went straight from the right lane, you may have crossed over a continuous line. You also possibly ignored the right turn only road markings. Added to that, the lane you were in had a stop signal.

    If you broke all of these rules, be happy that they are pinging you for just one of them and not all three.

    Did you go in the right lane cos the traffic in the left lane was backed up and wanted to do a sneaky in the right lane? That's why they would have a camera there, to catch people doing this very thing

    If that's what you did, then you're in the wrong and wouldn't bother appealing.

      There were about 4-5 cars, it wasn't backed up but feel free to make presumptions….

    In your case specifically:

    1. showing up in court at the specified time

    2. waiting a few hours

    3. brought into courtroom for 2 minutes

    4. told you're paying the fine plus added court costs.

  • Im not sure if I'm understanding your story correctly but you seem have have tried to change lanes at the traffic light but instead you crossed the line in the right hand lane that triggered the camera, then moved left in the intersection to go straight.

    Might be helpful to share the pictures from the camera. The red light camera takes two pictures in quick succession. So if you were moving really slowly, it might still look like you were going to turn right (against the red light). If you were moving fast, the second picture might show you being at the other end of the intersection going straight (which will help your defence).

    From what I understand you've probably broken 3 road rules all at the same time. One being crossing the solid lane, 2nd turning a right only left into the left lane and 3rd you ran a red light as you triggered it the camera from switch lanes.

    Running the red is a serious offense and you can't get downgrade it to a warning.

    Yeah…you will end up with more costs and fine. You crossed the line, whether for going straight or turning right - crossed the line on a red light.

    You think crossing a red light is fine if there is no oncoming / crossing traffic?

    Thanks for all the great folks. Going to just cop the fine and be very very grateful that I didn't get done for about 14 other things that you feel I did wrong also. I forgot I was also going to have to deal with the internet police by posting here
