VISA Expiring and Completed 11 Months in Australia Already in The Last 18 Months

Hello,

My mums visa will be expiring in mid April (Last day to enter I mean) and she has been with us past 11 months in the last 18 months. I cant send her coz of the COVID! and the flights ….

I have applied for the 1447(waiver) 2 weeks back and havent heard from Immigration at all…

Dont know what will happen…

Can I get some guidance what can be done

    Does the website say for a timeline for 1447 waiver?

  • I would contact local migration agent/lawyer for visa advice if I were you. Some of them offers free initial consultation too. Call them first and find out before you go in. Otherwise, you can visit the Department of Home Affairs for guidance too.

    It seems standard processing time for the 1447 is 28 days as shown on the form. Refer to

    2 weeks aka 14 days…. quick google says it takes up to 28 days. So you'll have to wait another 2 weeks.

    I would guess they are hammered with requests all like yours due to not wanting to fly home or flights being canceled.

    To be fair, the COVID-19 issue hasn't just appeared overnight, it's been a few months in the making, all countries have been warning to return home before the borders are closed and flights are stopped. So why didn't she?

    You could have made the choice to send her home early, as you had been warned international flights are expected to be canceled and borders closed.

    Don't forget to extend her health insurance also ;)

        Ok bhai

        You wait til 28 days, last day you wait for the waiver, if none reply, then apply for visa visitor 600 in Australia. You apply online and get new visa. You will not get the visitor visa immediate but will be grant bridging visa so she is lawful.

    How does this work? I thought 6 months was the longest they could stay at one time.

    • So one stint of 5 months then a break and back for 6 months. Seems simple enough to me.

      • He said she has been with them for the "past 11 months" , not that she has spent 11 months out of the last 18 with them.

    My mums will be completing her 12 month stay in end of April 2020 and she has no further stay condition on her visa after that date and her last date to arrive is also mid April 2020. We have applied for waiver 1447 in mid March. Haven't heard back from the immigration team.

    What happens if she stays beyond the date of visa expiry?

    Are the immigration team granting positive waivers in these times generally?

    Has anyone got the waiver recently..??
