Rights for The Seller on Facebook (Marketplace)

Hey guys,

So I've started selling no longer using items on facebook, recently I ran into a problem which I concern about my right as a seller. The story is my brother gave me his Iphone X which has issue with face ID and a small part of the screen went blackout. I used it for a couple of months and find no problems with it except the face ID. I decided to sell it on facebook and has mentioned all the issues come with the phone.

There is a guy who want to buy it, I gave my address and give him the time to examine the phone and said if he's not happy it's okay to not purchase the phone. He was okay with it and took the phone home.

A day after, he texted me and said there are some problems with the screen, there are stripes appear on the phone and the screen has come off. I was shocked when he sent me the video because when I gave him the phone, it was in good condition. He started threaning me if I'm not doing a refund he will report me to the police. Even when I said I will give me 100$ back because I feel bad when he experienced that, but he wanted more and he said he already submited the report about me doing a scam to him.

I feel unsafe since he told me that, I want to ask you guys if you are aware of legal stuffs. Can you explain to me whether I have some advantages in this situation?

    Edit: sounds like the old switcheroo where they swap your stuff (or parts of it, the screen in this case) with their own broken stuff, then return the broken stuff to you.

      Probably had that broken iPhone, looked for one that was broken enough that it could feasibly be the same phone. scummy. Like just get it repaired man, you paid $100 for an iPhone X.

    the police wont give a shit, tell him to take you to court, sale is final uness a judge says otherwise.

    if the phone was already in that condition and you knew this take it back, might be better than having a smashed window

    use the money earned to invest in cctv

  • I learnt a lesson from that, not to give anyone your address when selling second hand items. What made I confident of giving my address is that in the past people usually gave me their address and tell me to come and pick up the items…

    Now I'm feeling really unsafe.

    • small stuff - meet at public space or just a random spot on your street/ outside your building

      larger stuff - give street address and escort buyers to your unit

    All sales are final. Don't pay him anything and tell him you'll report him to the police as a scammer if he doesn't stop contacting you.

    Already reading people say the buyer is trying scam the OP, that all sales are final. Have we forgotten already one the greatest forum threads ever on this website?

    I for one am more reluctant to believe anyone in these situations.

    OP has the buyer also threaten to call your mum.

    I never understand why people who sell items on Facebook Marketplace, Gumtree, etc. give out their home address? Meet in a public place and take cash only. It isn't that hard and as others have said all sales are final.

      I’ve sold plenty of things from my home address and if someone wanted to meet in a public place to sell me something I would automatically think they’re dodgy and wouldn’t meet up/purchase. Just my opinion.

      • Yes, you've got it Flophunter. When the iPhone 6 first came out (before Mobile Monster, Mazuma etc became common), I was buying and selling 2-5 iPhone 6 mobiles a week (for a small profit per mobile). The only times someone refused to give me their home address for pick up and instead asked for a public place meet up, was when they were trying to rip me off.

        The most notable case was a Facebook dude who lived at Ipswich was selling an iPhone 6 for a good price (good but not insanely cheap). I messaged him straight away to buy it and he insisted on meeting in a public place or coming to me. I finally caved and said he could come to me if he really wanted to (45 min drive for him) and then after him not turning up at the agreed upon time, I worked out from other people responding on the Facebook post that he had been going to different Maccas locations on the way in to Brisbane and meeting up with people trying to sell his phone. People said it was in poor condition and it felt like it was overheating and one person even said it restarted when she was using it. After a few hours, he finally messaged me again and said he could come to me now so I told him that I didn't want his dodgy iPhone.

        Next public meet up (Samsung Galaxy S6 Edge when they first came out) - upon inserting my sim card, it couldn't be recognised. Phone wasn't blocked though so suspect internal damage in the slot loading sim compartment.

        Another public meet up - upon trying out the phone, I discovered the microphone didn't work. Ever since then, no public meet ups.

          I get what you’re saying, but there is no (fropanity) way that I am inviting some random potential headcase to my house to buy anything. OP’s post is the exact reason why I don’t tell people to come over here when I am selling things and it’s either postage (that I cover) or meet at the local service station under cameras or coffee shop/maccas.

          The last thing I need is to have to call the police because some retarded bogan (fropanity) head decides to turn up yelling and throwing shit at my house, or decide they see something else they like that they might “come back for later”. Yeah, no thanks. If they don’t accept to meet in a public space, then I’m happy to pass on them and move onto the next buyer.

          I’ve got better things to do with my life than to keep burying idiots in my back yard.

            @pegaxs: Pegaxs you're spot on mate. It seems like these people are too trusting of others. That's madness. If they've dealt with the types of people (not always) who regularly buy things off of Facebook Marketplace and Gumtree it's better to meet in a public place. Avoid the hassle, sell the item on the spot and move on.

            I've probably sold 100 items or more and maybe had an issue with 1 not wanting to meet in a public place to buy the item.

          Why not just make a list of what to check beforehand? You already have some experience with dodgy seller and phones, it would be easier for you to find out if there's a problem with the phone. Just tell the seller that you'd like to spend ~30minutes to inspect the phone , if they refuse then avoid them.

    It's a private sale and hence final. He should have taken his time to check the goods and the moment he leaves and pays for them he cannot come back to the seller. It's a risk he took.

    Those threats are just empty threats - just ignore him. You have more right to report him to police than him for blackmail etc

    If I live in an apartment, I would just meet outside the building and not disclosing which unit is my house. Chance of them circling around the building to find where I am living is quite small.

    I can’t help with any legal advice but in relation to the buyer trying to pass off an old phone for the one you sold him, can u request a picture of the phone he claims is stuffing up? Then compare it to the phone in your for sale listing. There must be some small detail on the phone itself that can show there r difference in the phone u sold vs the one they say has problems with the screen?
