Should I Quit My Job as I am required to work three days but only get paid for two days

Hi,

I am recently thinking about if I should quit my job. I am a part time working from Monday to Wednesday. My employer can only pay me two days a week but I am required to work 3 days a week. Then it's only about $106 a day. My employer said this is because of the current economic situation. I have lost my passion and I'm thinking about quitting the job every single day when I am working. But my friends suggest me wait until i find a new job as a lot of people are losing their jobs, and at least i still have a part time work to do. Last week, I was asked to work on Friday but haven't got overtime pay. Today, he asked me to work four days next week.

Besides, there is no work-life balance. My employer sometimes discuss work late at night and early in the morning before we start to work. I feel like my personal life has been affected.

Should I quit my job now?

  • Straight to fair work or HR if your work has one. I had a similar issue last year, I went straight to HR, got my overtime paid the week after. Havent had an issue since.

Sitting on it wont get you anywhere, unless you are worried he will fire you and you have no where else to go. In that case above advice is good, record/screenshot EVERYTHING, once you find another job, then you take him to fair work.

I would prefer the first option of course but every situation is different.

  • Is this cash on hand? In any case, it sounds like you are being exploited. I feel sorry that you have to go through this.

  • If you are working 3 days and making $106 a day you would probably be eligible for a partial Centrelink payment and if you get a partial payment I believe you still get the extra $550. I would recommend keep your job, get partial Centrelink and start looking for other jobs.

  • I would ask your union. Without exact details we can’t give advice. Also, if possible illegal work practices, report to fairwork.

So OP, plenty of advice above. What are you going to do?

$106 a day… Thats too low; Find a new place soon as possible while you have the current job. Quit and report to fairwork.

  • hi mate,

There have been a lot of employers like yours being named and shamed publicly on the news lately, even big guys like Woolie :
    https://www.abc.net.au/news/2019-12-16/woolworths-agm-underp…

Thus, keep the log of your unpaid days and log a case with Fair Trading body. I'm sure that they do have more works (otherwise, why they asked you to work extra ?? ), which means more income. They just use the current situation to exploit you.

  • Yea you should because it makes sense to quit your job, not because of the 3 or 2 days thing, or that you have the opportunity to put it on your resume, or even the fact you have a job 😁 but because it's the right thing to do.

hm working 3 days for 2 days pay, or working 0 days for 0 days pay.
    tough one

  • Record your hours.

Location data, if enabled, from your phone's map data is an amazing tool to help you work out your underpaid hours.

    Find your award:

    https://www.fairwork.gov.au/awards-and-agreements/awards/lis…

I prefer to google "[job title] award"

Find out your hourly rate. Apprentices and younger workers are first, then casual. If you are an adult, you might need to browse to near the end of a 60 page award.

Find out your loads and when they apply (evening, weekend, public holiday, etc.) Find out your award's reimbursements (PPE, uniforms, tools, ect.)

Put it all into a nice spread sheet

    https://lmgtfy.com/?q=how+to+use+google+sheets

Once you are ready to quit, ask your boss for what you believe you are owed as unpaid wages via email. If they reply anything other than, "I will fix you up next pay cycle" make a formal complaint with Fair Work:

    https://www.fairwork.gov.au/how-we-will-help/how-we-help-you…

If they cut your shifts or fire you after you ask for what you are owed, complain to fair work.

If fair work fails, research if you need to use your state's tribunal or small claims court. Google "[your state] employment tribunal" or "how to make a claim in [your state's] small claims court"

Keep working while you find a job.
With the current economy I’ll be glad to still have a job
Not saying it’s right. Just balancing it out.

By the way, can’t speak for all ppl in the bank but at least for me and my team, our contract says 37.5hrs. per week. I normally start at 8am leave at 8pm if I’m lucky and sometimes weekends too. Nope I’m not alone. I see other people in the office building when I go in on Saturdays and Sundays.

$100 per day job with one no pay day??
      No thanks.

      • maybe its a mentality thing.
i'd rather get 100 per day than to dip into my saving
unless i have a better alternative, which in this environment i dont know if i do.
do i think its right? no.
do i have a choice? well i dont know about you but i dont.

    • There is a difference between a salary and getting paid wages.

  • I don't know you should quit or not , just wonder why the hell you are still working there .

  • Some people really have no choice but accept what was dictated by boss. When I first came to Australia I was only paid $6.5 per hour with no super or any other entitlements.

My suggestion is: If you have no other choice, just do it but do not sign any agreement. In the mean time please record down the hours worked. Once you want to move on, ask the HR/boss to repay back.

  • If my employee cut my wages to 80% due to the corona virus and said I should only work 4 days I’d still work the 5 days.

  • you sure you can find another job right now? $0 or $200+ a week, think about it

    OP posted and ghosted.
    Troll post?

    • I think it is because it doesn't make sense unless the work is illegal. Job seeker pays more than this for not working and if the business is still operating (but is suffering from the economic situation) job keeper will probably kick in…

      • job keeper will probably kick in…

Op wouldn't be eligible for jobseeker if he is a temporary migrant.

    • +1

Probably contemplating all the responses he's receiving and then deciding afterwards. OR he's employer has now stopped paying him and now has no money for internet to update his post here with comments….

  • Job Seeker is about $560/week before tax, with no asset tests (at the moment, because of Covid).

You have to decide if its worth burning the bridges at your current work place and having to try and find a new job in 6 months, to get job seeker instead.

  • Hang on to the job for now. Look for a new job in the time being. If you quit, staying home with no pay is worse. My asssumption is you don't qualify for jobseeker or jobkeeper. Things may be bad now, but in few weeks time there will be change. Be patient, I hope things work out for you.

    A few things to consider:

    • $0 vs $200+ per week?
    • 3 days work but no work life balance? Are you also studying? You can't really say there's no work life balance because you're working the same amount as you were working before.
    • Are you entitled to jobkeeper?
    • Are you better off on jobseeker?
    • If you're a migrant worker consider the flip side: No government support, no pay, all this spare time, but no money to spend.
    • Some people can’t handle working more than 2 days a week.

      • OP seems to indicate he was always working 3 but is now upset because OP is being paid for 2. Seems OP could always handle 3 days a week just can't handle it at the new rate.

I agree OP's boss is taking the p*ss but OP needs to consider the reality of the current situation as well.

        • Great thinking , so OP getting paid less than $70 a day for 3 days . Might as well work at Macca's for 3-4 hrs a day in one of the lowest paid jobs to be on par ONLY if a Junior needs to apply !

  • Instead of quitting you should put your foot down and say no to the extra free day of labour. You're thinking of quitting anyway, let him fire you on illegal grounds.

  • Just no-show or call sick the third day.

You're casual so they don't have a leg to stand on ( Don't need to give medical cert or excuse ). If they fire you go on JobSeeker.

Have you discussed your feelings with your manager? Empathy flows both ways, try to understand the situation from their PoV.

You might be very valuable to them and they might not want to lose you - see if something fair can be negotiated. Otherwise, you may consider involving Fair Work Australia.

    'scuse me
