Submitted name transfer & VicRoads has no record. Now at final submission so cannot transfer fine out of my name

Any idea how I can transfer the fine now? Called Vic Raods, they put the blame on me saying I should've followed up and said I can apply to get the fees waived but have no way of getting the fine transferred also fees would be unlikely to be waived.

Sadly the only proof I have that I submitted the transfer is that I visited the fines website on the 29th (computer history). I checked the photo of the incident and there isn't photo proof it was not me driving however I added her to my insurance the day before she went away for the weekend on a uni trip so obviously there are ways to prove I was not behind the wheel.

Rough timeline.

  • My sister was speeding 10km over the limit on 13 March

  • Applied online to transfer the fine to sisters name 29 April (Past due date)

  • Received reminder the following week 4th or 5th of May saying it was overdue. Assumed reminder notice was already in the mail so wasn't concerned

  • 01/05 Received final notice reminder. Valid 2017 of may

Get the feeling I'll just have to eat the fees and cop the points and get my sister to reimburse for the value of the fine.

    You'll have to eat it or go to court but it appears submitting the fine transfer late was where it fell over.

    • Is court a remotely viable option?

      • Court is always an option but what is your defense? "I got the fine but was late going online to nominate my sister."

        If you haven't accumulated any points and this is only worth 2 is it worth fighting?

        Personally, I'd cop the points, make my sister reimburse the fine and not let her drive my car until the points have disapeared.

        • Just to be clear I believe it was a glitch in the system not that I applied too ate. You can transfer fines after the initial reminder but you cannot once it hits the final stage. The mistake here is that I didn’t follow up or note the reference number

  • Why don't you just apply to get the fees waived and get your sister to reimburse you? Is it really that big of a deal that you want to go to court over it?

    • Yes very unlikely I got to court over 2 demerit points was just curious what my options were.

  • In future, and if done prior to due date, you can apply to have the fine changed to just a warning. They say on their website that if you haven't received a speeding fine in the last 2 years, that it can be (effectively) changed from fine to warning.

    My two speeding fines were fortunately 10 years apart, such that on both occasions I enacted this option.

    Another lesson is don't leave these things until they're too late or past due, and then expect it all to work smoothly.

    • Am aware of this. This is “my” first fine in 6 years and the last one I got down to a warning.

    Didn't drop your car off to a mechanic and leave it there for, oh, say…. 18 months or so, by any chance?

    Vic Roads suspended my licence for a medical review recently. I passed the review but my doctor suggested going direct to a Vic Roads location, submitting the paperwork in person and getting a receipt. He said that VR has form on losing submissions.

    You are dealing with public servant bureaucrats who dont care.
    Call dept trading and your local state member
    Or take the matter to court
