ACCC - Refurbished TVs - Bestbuy Electrical

Hi All,

On the lookout for a new TV and noticed this site:

https://bestbuyelectrical.com.au/

It seems the prices are very good and they also off 1-year warranty.

I was after a Hisense TV and they have told me that I can't go back to Hisense if there's an issue and I must contact them to get it repaired.

after reading this:
https://www.lifehacker.com.au/2014/08/ask-lh-what-are-my-con…

Should the retailer cover it for longer in case of an issue? If so, how much longer if it's a 65" TV for $799

So confused with the ACCC documents as everything is so vague! Can someone shed some light in terms of what rights I have if something was to happen after 1 year? Thanks!

This retailer is providing the warranty for refurbished or factory 2nd goods. Buy brand new if you want to deal directly with the manufacturer.

    • It's not that I want to deal with manufacturer directly, it's the fact I would like to know if it could potentially be covered for longer than 1 year… I don't mind going to retailer..

      • Statutory guarantees aren't set in stone. The minimum is 12-months with a reasonable time after that.

        • yeh, that's what I thought too. It's quite hard for a consumer to judge what "Reasonable" time is.

Based on the phone conversation I had with the staff, she was saying anything over 1 year, they can service it, but I need to pay - and she said it's company policy" and when I mentioned it's an Australian law that it overrules company policy, she said she has no idea..

          • @cheapass88:

she said she has no idea..

She is right. She doesn't have to know all the ins and outs of the ACL. It's the consumer's responsibility to do the legwork if they want remedies outside of warranty.

@cheapass88: I don't think its reasonable to expect warranty after the 1 year currently offered. You are buying a refurbished tv and a low end TV that my guess would have had an RRP towards the lower end of the scale. Based on that, its unlikely you will get free warranty service after 12 months as you would reasonably expect to if you had bought a brand new high end premium brand TV say for $3k (e.g. Sony OLED).

What will happen in your case? If you encounter a problem after 12 months, I believe the store will refuse to help for free using the rationale above.

  • You can absolutely try to go back to the retailer to argue that your ACL rights extend beyond the 12 month express warranty. Whether they agree or not is a different story and it's a matter of whether you can be bothered enforcing your ACL rights against a business which might not even be around in 12 months' time.

    • Thanks for the response, I will think about it before i buy now!

As I understand it if you buy refurbished you have the same rights as if it was new and you bought it in new condition.

    Could be wrong.

"Second-hand goods are also covered by the guarantee, but age, price and condition must be taken into account. … This guarantee may not apply if it is unreasonable to rely on the seller's skill or judgment, or if you purchase the product despite advice from the seller that it will not meet your particular purpose." Accc.

      Uncharted waters my friend.
