[VIC] First Speeding Fine under 10kmh (2 of The Same Day)

Hi guys,

Bit of a tricky one here!

I am aware that with a clean driving record, you could apply for a consideration of an official warning instead of infringement.But I got stung twice (within space of 30minutes) by the same camera in VIC.

Ofcourse, there is no excuse for my ignorance and I am totally responsible for it. Both are under 10km/hr.

While writing the application, I kinda got confused as to though it's my first speeding fine ever, there are 2 so not really first if you know what I mean. Other than that, clean record of good 12 years.

Has anyone personally been through that? I would appreciate any help form someone who could guide.

Otherwise, I have gone through enough related posts as to what to write etc.

    You can write a letter. Look at it this way. 2 fines over 12 years. Not really a deal breaker. Kids zone was it.

    • No, 68 and 69 in 60 zone.

      The road went from 70 to 60 and I didn't see the signs of course.

    Not going to happen.

    If you get off the first fine the conditions include that any subsequent fines in the next 3 years will need to be paid and also back pay the original fine.

    Don't waste your time.

      How can they reinstate a fine once they withdraw it and issue a warning instead? Didn't happen when I was let off after applying in writing.

      • This is going back 10 years for me. I got off a less than 10 kmh over but was advised in writing the above.

          Mine was 8ish years ago and I don't remember getting that reply but I definitely got another infringement within 3 years and never had to pay the original.

    • I've never heard (or experienced) of the backdate part. I'm in NSW so other states may differ.

      Source: I've copped a few fines in quick succession with >10 years of being good before that :-(

    If you get two fines in quick succession the same leniency applies, you can ask (and will probably succeed) to get one of the fines withdrawn. You won't be able to get both removed though.

    (Holiday weekends with double demerits are an exception, nobody gets leniency during those.)

    • Yep, best you’ll get is getting one of them withdrawn. I got done on the Peninsula Freeway a couple of years ago and wrote in, they withdrew one of them but not the other

    There is a rule that allows cancellation of second fine if you are in the low range speed (<10km/h). This happened to me when i was pinged twice on the same day on the eastlink.

    Research on it further. You should get one of the fines off, but not both.

    Write a letter about being fined twice on the one day stating that have not had the chance to correct your driving habit from the first fine before the second fine was issued.

    Nearly worth taking it to court. Same camera, same day, they are taking the piss here, magistrate might make you pay one and cancel the other… down side is court costs and the loss of a day will probably equate to more than just paying the ticket, and that’s what they bank on, but with a clean record for 12 years and these being low range offences, you may just get them waived.

    There is also some information on the VicPol website about multiple infringements on a single day… Might pay to have a read about that…

    • this is the correct thing to do.

      1) apply to have the second infringement to be withdrawn. a) it was a low speed infringement, b) it was issued on the same day as another infringement prior to you becoming aware of the first infringement

      2) apply for the first infringement to be reduced to a warning based on your good driving record

        I thought about the same but doubt I will hear back from them for the first appeal by the time the second one is due (19 calendar days) from today. After going through various posts on this platform, the average time it takes for them to revert is 3 weeks. And with the current situation, it might just be longer.

        Do you know someone who has gone through a similar process?

    You can get fines close together rolled into one, poster above has some info on it…… But if you can then get that fine waived as part of a good driving record? I personally think you'll be pushing up hill on that one to combine and then waive.

    So you're choices are

    • ask to roll the two fines into one being they are close to each other and you hadn't been aware etc. I then doubt you'll be able to waive this combined fine, but you can always try.

    • Ask to waive the first fine, pay the 2nd fine.

    Either way, it looks like you'll be paying a fine to me.

    Also book in for a eye check, as you missed seeing this sign TWICE in 30 mins.
