Public Dashcam Footage and Privacy Laws

This was originally posted on Dashcam owners Australia whom I have been following for a while and has since been picked up multiple News outlets.

Apparently, the genius here has now threatened to sue DOA via a Law firm. You can find this on their facebook page

I am really curious to know what OZB community thinks about this kind of behaviour, which should fall in line with most of the FB comments as spackbace mentioned here and also, the privacy laws around dashcam footage in public places?

My reason for posting it here, to make idiots like these outed so that they realize they cannot threaten people and get away with it.

          your rebuke is just an attempt to claim that you are not pandering to the same level of hysteria over this when you clearly are, that's why you posted it here and that's what you mentioned it in your first title edit.

              @UFO: no i'm not. if you actually READ my posts without such hatred for someone clearly having a mental episode under some duress and actually realise that women abuse men in similar circumstances that never properly do the rounds in media you'd understand that this is all just a big blow-up that doesn't even really belong here.

              i've stated many times i don't like this guy either but the threat was empty because nothing happened and the incident was minor because again - nothing happened.

              you can rage for many days about this as much as you want but i can bet you the police won't even charge him for this because they have much more serious matters to occupy their time with and the judge would throw it out quickly. he will change his name and move on with his pathetic life.

              if you think organising the internet police to go and severely beat him to near death is warranted then you might as well move to a country without any human rights and see how you manage to fare.

                There was no duress in the scenario for that male. I don't see the female forcing him to act that way. That was the way he behaved based on the situation he was in i.e. he might have been stressed.

    Yeah, he's an aggressive idiot and dashcams are needed for situations just like this.

    Sad thing is though, the news is only interested because it's a mother bring threatened. If it was a father in the car, they wouldn't give 2 rats. That's despite more men being victims of violence.

  • So has the OP's question been answered? Whats the law around posting identifiable personal information (car plates, people faces) taken from non-private area online?

        • What is personal information depends on who and how the data is collected and how it is used.

          Read up on the Commonwealth Privacy Act 1988. It deals with a different matter of privacy, not a person's likeness or car plates which are publicly visible.

        no, he got out of the car in a fit of rage and he would have said anything to anyone. it didn't matter.

          I was in a car with a mate, he was a rough guy, both guys got out of their cars with baseball bats but nothing really happened bahahah

            he actually did exercise some restraint aside from the physical threat. no windows were smashed, no fenders kicked in, no cars were damaged.

            this is the weakest road rage video i've ever seen.

      • She was on the phone to her husband at the time. In the original FB post, the husband comments that as soon as he started speaking to the guy he shut up, quickly retreated to his jeep and left.

  • I'm not a lawyer but I suspect the video publication is not an issue. However depending on the state it may be illegal to record (and publish!) the sound of the conversation without warning the other party.

    • INAL you're right that there is issue with where and how you can record but in NSW you can record in this circumstance because there is no expectation of privacy.

    • Talking loudly is not private when/if other people can hear it.

    • Wrong suspicions, nothing illegal about the recording or publication.

      Only thing illegal here is the threat to kill someone.

    I remember seeing this. The lady is stopped behind where a line of cars would be parked if it was parking on both sides. I wonder if he would have blamed stationary parked cars that he needed more space to get out.

    In law, you get a lot of bad lawyers threatening people who don't know the law. The cover page, logo, words like 'sue' 'police' tends to scare people. But at the end of the day, they don't have a case. If they do, I'm 99% certain they will lose. But the lawyers actually don't care, $$$ is coming their way whether they win or lose.

    P.s Im a paralegal and just finished my law degree
