[Speeding Fine - VIC] $200 Reward for Dash Cam Video on Western Ringroad Ardeer Southbound on 9 Nov 2020 at 10:09:31 AM

Hello people,

I'm not sure if this is the right place to post for this but I really need some help. Please let me know if this is not appropriate or advise me a suitable forum. Thank you.

Two weeks ago when we drove past a 100 km/h zone at Ringroad, Melbourne, to visit a friend, the variable speed sign was blank, so he carried on at 99 km/h. However, we received an infringement notice two days ago. It turned out that there was a road accident at the time, and the speed limit dropped to 80 when we past without showing on the speed sign. We unfortunately cannot contest because we were driving our spare car, which has no dash cam to prove our words.

To give you a little bit background, my partner is a professional driver of 24 years with over 4 million kms experience, whose latest at-fault accident was in 1999. He's been living in Melbourne since 2004. He is very cautious with Redflex speed cameras, always looking at those signs because he knows how nasty they can change. He remembers clearly that the signs were blank because at that time we were on the phone with the friend, and he said: "Hang on, here we come to the speed limit… and it's blank."

So we need your help. If you happen to have driven through this road at the time, or know people who has footage of the speed sign of the time, please share with us. We know that the chances are slim but we'd rather not take the demerit points when we actually follow the law. (Those points are important for his career.)

    Does asking for dash cam videos ever work? Surely everyone's footage has been overwritten after like 3 weeks

    • We'd have saved our own footage if we were driving our usual car, which was being serviced at the time.

    If you offer $200 for the footage, that might be worth someone's trouble. It is kind of an effort to retain, and sift through 2-weeks of footage fyi. That reward amount would beat the fine's amount, plus no speeding on record or increases to your insurance. And it would make the dashcam owner feel rewarded, seems like a fair trade.

    Otherwise, take this as a lesson to buy a dashcam…. they "literally" pay themselves off.

    • We usually have our own dash cams, but that car was being serviced at the time. This car is really old, usually sitting in the driveway. Thank you for the advice. I'll update the post with a reward.

    Were there emergency vehicles attending the accident?

    Your best chance is trying to find a truckie on DashCam Owners Australia.

    • Yes, there was emergency vehicle. The accident was a white Mitsubishi Triton with a tandem trailer, according to my partner's memories.

    won't be surprised if there's no speed sign. They need to raise revenue for the government especially now.

    • As much as I don't trust the government, I don't trust Redflex (speed cam company) even more. Their business model is not very citizen-friendly, nor consumer-friendly. They want governments to pay them more.

    How will you use the third party evidence?

    • We're trying to prove that the variable speed sign was blank. Because it's a 100 km/h zone, we were under 100.

    • None at the moment. All I have stated is from our memory.

        • Did you meant photos from Fines.vic? Yes, we did. The photos on fines.vic are not from the exact time of our passing time. Thank you for the tip anyway.

            @ntol18: What? They will show the speed limit displayed on the nearest variable sign. Doesn't need to be exact. WHy not post the photos? You remember the exact time you passed a speed camera 2 weeks ago?

              We did check the nearest variable sign photos on fines.vic, which all interestingly show 80, but those photos were taken periodically, and the none of the photos were at the exact time of our passing time. We remember driving at about the same speed of the surrounding cars though… (My partner knew there's a speed camera at that spot, that's why he remembers himself checking it. Hence, this post.)

              Please correct me if I misunderstood your point.

                  We're prepared to pay the fine. We're only here to try our luck if people happen to have a footage that we can use. Thank you for your time and advice. You're very kind.

                  To be honest, if it had been me driving, I would think that I made a mistake and wouldn't bother much, but my partner has a pretty amazing visual memory of what happened on the road he drove. (Like he still remembers the exact vehicle in the accident at the time whereas I have absolutely no clue.) I understand how this would look to other people, but we'd like to seek any possible solution before we have to accept it. I was the one who came up with the idea of posting a request online. He was ready to pay.

                      @pegaxs: I don't see the harm of looking for a chance to dodge a bullet. Like I said in other replies, we drove at about the same speed of everyone else.

    ENFORCEMENT OF VARIABLE SPEED LIMITS
    27 Video cameras continuously monitor the LUMS (Lane Use Management System) signage to which the road safety cameras are linked. When a potential infringement is detected, an image of the vehicle is recorded.
    28 In addition, images of the LUMS signage are also recorded: a.At the time the potential infringement was detected, b.30 seconds before the detection, c.60 seconds before the detection, and d.90 seconds before the detection. These images form part of the evidence package for any potential infringement, and aim to show that the speed limit was continuous for at least 90 seconds prior to the detection of the potential infringement.
    30 The LUMS images, along with infringement images, are available to motorists, and can be viewed on the “My Fines” section of the Fines Victoria website, www.fines.vic.gov.au.
    31 When the speed limit is lowered, a grace period is applied, to allow a reasonable period for any motorists in the vicinity to comply with the change in speed limit. The duration of the grace period varies and depends on various circumstances and factors. It is a Victoria Police matter.

    Take particular note of "30". I think the government might have a copy of the photos/video you may be looking for. Have you tried there, yet??

    • Yes, that's the first things we did. Those photos from Fines Victoria website interestingly show the speed limit number of 80, but the photos were taken periodically, and there wasn't one at the exact time when we drove past.

      My partner remember driving at about the same speed of surrounding cars… so we could be one of those really unlucky people.

        The photo of the infringement should have the time on it. The photos of the variable speed signs should have the time on it. When you say "not the exact time" are you talking hours, minutes or seconds from the infringement time?

        It sounds like they have you dead to rights and you're going to try and play the "but the photo of the sign says 80km/h @ 10:42.38am and we went past it at 10:41.57am…" I don't like your chances.

        I am guessing you are clutching at straws and looking for that needle in a haystack because someone already has near maximum demerit points on their license and this tips them over the edge?

        • I understand why you feel that way. There's still lots of room for him even if he has those points. He's just a careful driver who doesn't' like taking chances or for being held responsible for what he didn't do. I'm the one who suggested to post to search for videos. He's ready to take them.

          • @ntol18: I'm trying to help, but you are dodging the question. What time were the photos taken, the infringement photo, and any/all of the variable speed limit sign. I'm trying to use some math to help you out, but I cant do that unless I know times and speeds…

            Were the photos from the infringement and the speed limit sign vastly different (hours)? or just minutes/seconds? Also, what speed was he charged with? 100? 90? 83? that would help as well.

            • @pegaxs: Ah, I see your point! I didn't understand the importance of your questions.

              We'll try to work out the math ourselves first (because he's sleeping now. His shift starts 3 am tomorrow meaning he has to wake up at 2 am). And face the time of truth. He's charged with 99, allegedly 97. If I remember correctly, the photos have minutes difference. We will do the math. Thank you for your advice!

                @ntol18: You cant log in and view the photos? Was it minutes, as in 7~10+? or was in 1~2? Kind of feel like you are being deliberately vague.

                Edit: Doesn't matter, I've done some of the math for you…

                I have used the figures shown in the above paste from the Camera Commissioner's Almanac finding "28" (30, 60 and 90 seconds) and applied it to your vehicle, on that road and at a speed you were approximately doing.

                In this trip, you passed 5 speed limit signs.
                At 90 seconds, you were 2.5km from the cameras, at 60, 1.66km, at 30 sec, 0.83km.
                There was a "Road Safety Cameras Operate in This Area" sign about 300m before the second last variable speed limit sign and about 1km from the cameras themselves.

    Where do you nutjobs hide when not clocking up fines

      With > 450km travelled every day, 365 days a year, they could be hiding anywhere!

    • Minimum 4500 km per week, for 10 years driving interstates, plus 3000 kms for the rest driving local and country Victoria. He has friends that have done close to double that.
      It's not unusual for him to have 14-hour days.

    • Thank you for your reply, but he has Victoria license. We don't really mind the fine or the insurance raise, but we really care about the demerit points.

    Ask a letter asking them to waive the fine. If his driving record is so good, they’ll waive it as a warning

    • Usually the government won't grant the waiver if you're above 15 km/h of the the speed limit. (We were driving 99 at a supposed 100 zone, so we are mentally prepared to pay the fine… We just want to try our luck here.) We don't mind the fine, but the demerit points do hurt.

        And the warning is for 9kph over, not 15

        • Because for certain special driving licenses renewal, if you have 6 or more demerit points, it can cost you lots of money and trouble at work.

          15 is what I heard. Maybe I got it wrong. (I'm not really a car person, nor a number person. It's very possible for me to confuse those things. Haha.)

  • If the fact is what you stated. Everyone who drive pass should contesting their fine, I think finding similar driver also helping. I am sure everyone who drive pass at similar time would get a fine.

    A solicitor would be able to procure all the information form the authorities themselves

    You dont need a dashcam to contest
    Simply state your case
    If need be take the matter to court
    Most judges are very reasonable
