Received Incorrect Phone

I recently ordered a phone. When it was delivered, it had my name/address on the box but the packing slip inside had someone elses name. Also, the phone i actually received was better than the phone i ordered.

Should i return it? or pretend like this never happened?

What am i obligated to do in this situation?

  • Use it asap then it's used. They will probably just tell you to keep it.

    • I was hoping this might be the case. I genuinely opened the box before I even realised it was the wrong phone so I've broken the seal. I just get intense guilt with these kinds of things! It helps that it's a trillion-dollar company.

    Some people don't even realise their Mac book is a different colour until 2 years later…

    Anyways, you got a phone, looks like a phone, brand is correct. 👍

      Can always try to threaten them with ACCC 2 years down the line to get a new one right?

    if they don't notice in 3 months you can keep it.

    Though a bit of a grey area since you did order a phone, just not that phone, and the packing slip had someone's else's name on it.

    How likely is it the other person got your phone or Samsung just hired clowns at the warehouse that juggled all the phones into wrong boxes. Unless it is a direct error it would take them so long to figure it out they would probably just give up.

    OP, the only thing non of us has raised yet. In case of warranty, phone won't match invoice? 😬

    You can't claim warranty without having a receipt. I would tell them what happened and that you had already started setting up the phone before you realised the mistake.

    They will either let you keep it, make the correction, or you could perhaps offer to pay a portion of the difference. Then they can make sure you have the right documentation for your warranty.

  • The invoice in your name won’t match the phone though and the Imei number would be different.

    Quite possibly they try to block it if it gets reported missing.

    I’d be honest.

    Let them know, tell them you’ve opened etc.

    Would hope that they’d say thanks for honesty keep it.

    If they want to arrange courier to come and pick it up they could also do that, is up to them to arrange.

    If you get to keep you will have knowledge that is yours, not look at guiltily until you get rid of it.
