Vendor Delay, Won't Sign Mortgage Release Papers

signed contract for house (QLD), settlement Thursday
vendors are divorcing husband and wife. one is keen for the sale to go through, the other won't sign the mortgage release papers.

what would you do, seems the non cooperating spouse is stubborn and refuses to budge, hoping we will go away. I assume this is either to spite the other, or a better offer has come through.

I honestly can't be assed with this clown, and am either going to terminate and sue for damages, lodge a caveat if need be or just offer 10k more if he signs the mortgage release by that afternoon and grants early possession.

    That is pretty annoying. I wouldn't offer more and would expect your solicitor to have measures in place.
