Telstra Plus refunded points instead of replacing

I did order a Sphero Kit thru Telstra Plus points and $17.

The toy came DOA and after several long chats I got told that Telstra Plus cannot replace, and refuded the points. Still waiting for the $17.

I checked online and they still have the Sphero but this time it would be the 25K plus $75. Now I know why they did not want to replace.

Can I insist to get the Sphero replaced ? ( The points are already back on my account )

  • When you have a major problem with a product, you have the right to ask for your choice of a replacement or refund. For a major problem with a service, you can choose to receive compensation for the drop in value below the price paid, or a refund.

I think you can insist on replacement esp if you have chat records showing you wanted replacement.

Agree, but T+ says they cannot replace it. Even if it's on their page ready for order.
The whole thing is a shit show. They asked me to contact the manufacturer in the US, then another time they referred me to some additional "extend" your warranty site. In the US again. And you cannot talk to T+ but only to Telstra agents trying to solve mobile phone subscription issues.

      • Just saying I think you have grounds to keep insisting.

But sounds like it hard to find the right person to contact.

While this is true for retail, I wonder if reward programs are included. Although we Ozbargainers equate reward points as cash, and redemptions as purchases, does consumer law specifically state this? Asking for a friend.

      • Yes, you are still buying something. This is the same thing with gift cards.

Otherwise I'd open a shop called Bogan and make you buy SmithPoints with cash and then use those.

The law says the refunds need to be in the same form as the payment.
