SUREdeal - Perth based Group Buy company. Changing contest ad hoc..... WTF!!!!!!!!!!!!!!!!!!

Sure Deal, a new GB company in Perth has been trying to get business by promising buyers of group buy deals who buy from them between 29 feb - 15 march an entry into a contest that has a prize of some cold chisel tickets.

I don't know why, but they have all of a sudden decided to extend their buying period until 22 March.

WTF!!!!!!

The people who bought on or before 15 march can honestly say that they were induced by the chance to win the tickets. By opening the period up to additional purchasers, they are depriving purchasers who were induced from as good of a chance to win. Basically, they are changing the deal.

I don't know if they are required to register this contest with state authorities, or if they did register it.

I do know that in my opinion, they should not open it up now.

What if a person were to buy a raffle ticket on the proviso that there were only 100 to be sold.

The organisation selling the tickets decided to get more bang for their buck by selling more than the 100 tickets.

Not fair to the people buying with the understanding that tix would be limited.

Not fair this either.

Getting sick of these half assed organisations changing rules after inducing sales.

I think this sirt of thing could be illegal in WA. Certainly poor form.

Come up w/ another contest if you want to generate more interest…..+

    All contests in NSW and I guess other states MUST be licensed.

    Check if the same applies in WA if so this maybe in breech of their license. That is if they had one in the first place.

    Group buying deal companies are the cowboys of the internet.

    Anyone who wants to make a quick buck seems to start one of these companies. After one bad experience out of two times using these companies, I steer clear of these. Like a Ponzi scheme, you can get a good deal, but its a gamble, with odds onto lose.

    Reading that its very much like NSW regulations except a permit is not required if some conditions are met

    Provided you meet the prescribed conditions associated with a trade promotion lottery, then you are not required to apply for a permit to operate your competition, but you must conduct your competition in accordance with these conditions.

    To quote some of the conditions

    P8. Where the trade promotion lottery is conducted by electronic media (other than audio or visual) all advertising of the promotion shall provide a description of the prizes and shall direct contestants to where the terms or conditions of entry are to be found.

    P10. The method for determining the winner shall be clearly stated in the terms or conditions of entry to the trade promotion lottery.
    P11. Where a trade promotion lottery is conducted by audio, visual or other electronic media a copy of the terms or conditions of entry shall be lodged with the Gaming and Wagering Commission prior to the commencement of the promotion.
    P12. Once the trade promotion lottery has commenced the published rules and conditions of the lottery cannot be amended without written approval of the Gaming and Wagering Commission.
    P13. Once the trade promotion lottery has commenced it cannot be cancelled or withdrawn without prior written approval of the Gaming and Wagering Commission.

    looking at their site where they have a promotion for Cold chisel tickets I cant see anywhere the conditions of entry etc. All it does it takes me to a facebook page where I have to like to see more details? I am not prepared to do this - have you seen the details? Personally I think this may be in breech of the regulations in that the conditions should be clear without having to do this, but thats up to the WA department. If I was a WA resident I'd probably refer it to them for their opinion.

    Secondly point 12 also covers your concern. And I doubt if this has been complied with.

    Now I am NOT a legal expert and this is a personal opinion, obviously you need to discuss this with the WA department. My only knowledge is through work related dealings with NSW departments, which do have different rules. As such this is NOT a legal opinion or to be construed as such. Its just friendly advice to point you in a direction for help
