MyDeal.com.au Terrible Service and won't accept return

I purchased some AirPods from Mydeal.com.au on 28 September. They took 49 days to arrive via Australia Post. I don't blame them for this, but in the meantime I purchased from elsewhere. Their listing clearly states they accept returns within 30 days, but they are refusing a return even though the item is brand new and still in the shipping bag.

The listing says:

30-Day Returns Policy

We pride ourselves on quality and always do our best to ensure the product that arrives at your home is as you have read and viewed on our product page. We want to make sure that you always receive exactly what you were hoping for and that you love your purchase.

However, we do also appreciate that sometimes the product is just not right, or you may have a change of mind after placing your order.

If you do change your mind, we are here to help. You can return the product to us within 30 days of the date that you have received it and we will be happy to organise a refund for the product for you. (This does not include the shipping).

There are no other listed special conditions

But the customer service people (who take a week between updates by the way) have said, "Sadly, all sales with Apple are final." and they are refusing to accept a return.

I'm posting this because I think companies that don't adhere to their own stated returns policy suck and should be avoided completely.

So, I'm left with two options - hence the poll.

  • Did you buy the other AirPods direct from apple? If so you might be able to return those ones as apple have a very generous return policy even on headphones.

    Change of mind policy
    A change of mind may include, but is not limited to, purchases where:

    You chose the wrong colour/size/product
    You believe the item to be unsuitable for your needs
    Your personal opinion of the quality

    Change of mind returns are given at the sole discretion of each Seller on a case by case basis. Please contact us to check if your return can be accepted by the Seller.

    If the Seller allows a change of mind return, they will ask you to follow their own policies and procedures for return. Items that are returned without the Seller's approval will not be eligible for a refund.

        1. CHANGE OF MIND RETURNS

        13.1 Sellers have their own policies and procedures in relation to change of mind returns. You must review your order carefully before placing it because change of mind returns are given at the sole discretion of each Seller and a Seller may refuse to refund or exchange Products/Vouchers for change of mind or errors a User made in their order.

        13.2 If a Seller allows a return, then the User will need to follow the returns process outlined in the Seller Terms, or any other return procedures or processes described by the Seller from time to time.

    It’s not really a change of mind return if it took 49 days to show up. I would argue that this is not fit for purpose since delivery was much longer than estimated.

  • How did you pay?

  • I have been waiting more than 49days and still not a proper response on the delay. They say it’s an Australian post but since AP is not dealing the overseas freight they have no idea on how it is coming, I am assuming they are using cheapest shipping method which is via (gulp) sea. MyDeal is also just a middleman connecting the overseas sellers so their policy doesn’t really make sense.
