Sold an Unregistered Car - Buyer Now Claims It Is a Write Off [VIC]

I sold an unregistered vehicle in Victoria - not written off on PPSR.

After more than two months, having the car in her possession, she took it to roadworthy and apparently she was told the car is written off.

She is taking me to VCAT to obtain a refund

Is she allowed to do that?

    A tribunal resolves disputes and make decisions.

    You say it wasn't written off.

    She's alleging it was written off.

    One of you isn't telling the truth or misinformed.

    The tribunal will figure out which is which.

      Even if op does not surely the magistrate can request a deeper record check and see if the status changed over the course of the last few months.

    depends on what pretense you sold the car.
    If you knowingly sold her a written off car on the premise that it could be re-registered you may be in a pickle.

    However if you sold it to her as is, unregistered then you should be good. but from the sounds of it if it hasn't been written off she doesn't have a case.

        • what happened was she took to for road worthy inspection and he told her that it was in an accident and its written off

  • ok well, could they mean that it should be written off. So not on any registers now, but in a write off condition. So maybe someone did a dodgy by fixing the car that should have been parts only etc. There was a big case that led to dodgy roadies being scrutinized here in qld. The front of a car caved in after impact squashing and killing the driver. It was found that the car was not correctly repaired beforehand. They then went to the used car yard in North Brisbane and found 30 - 40 vehicles that were similar write offs. That car yard was closed and rwc's became more stricter and regulated. If the sold car was in good condition, could also be some type of scam by buyer, eg body or part swap.
