JB Hi-Fi Not Honouring Marketing Email

So on the 10th February I received a marketing email directly to my personal email regarding preordering Samsung S22 series phones. The promotion was for the $100 eGift card for preordering using the same email address that received the offer email.

All is well and I preorder using the same email address on the 25th February for Click and Collect and eventually it was ready for pickup the 16th March. Picked it up and setup the phone no worries.

Problem comes when I contact them on the 29th March asking them where my eGift card is and they deny my email ever being on that marketing list for that specific promotion even though I received the email directly. Had back and forth email chats and calls which got heated and they kept saying I am not eligible as I am not on their marketing list for this promotion.

Kind of dumbfounded even after providing proof, they outright deny and not apologise for this and have closed the case citing my question has been answered. Curious as to see if anyone else has this problem and what steps I should take considering they dont want to solve this issue?

I've contacted Office of Fair Trading here in QLD but not sure if they can force them to provide me a gift card.

Update: 8/4/22
Office of Fair Trading has contacted JB, JB replied accussing me of manipulating the email. Going to QCAT now.

    I found in one of my various E-mail accounts an offer.

    Is the problem that :

    a) you received the offer and clicked on it and have now deleted it
    or
    b) JB saying "yes, there was an offer but you weren't on the list/entitled"
    or
    c) JB saying the offer never existed?

  • Lodge a complaint with OAIC that you were marketed but the company is refusing to honour the marketing emails.

        I would have just return the phone and ask for a refund and not do all this other crap .
        All these company have clauses and I'm sure there a$$ is covered otherwise you'd have a $100 gc .

            @Local Bogan: That's a them problem. Go to the store. Demand refund. You pre ordered and purchased on condition of the gift card.

            @Local Bogan: If the item is significantly not as described, you can return. In this case it was supposed to come with a gift card, and it didn't. So I'd say that's grounds.

            • @djsweet: Thanks guys, will keep that in mind if fair trading cant force their hand in which case I would need to buy a new phone first

  • Just to play devil's advocate. Was there a condition attached to the first e-mail suggesting you had to pre-order before a certain date? 15 days seems like enough time that the promotion could have ended. Was there another incentive already in place by the time you did pre-order - like a bonus gift or discount? Perhaps what they've intended when you spoke to them is "you're not on the list of emails who are eligible for the gift card as you didn't pre-order in time."

    If not, then maybe try speaking to a store manager at your local store - they could probably escalate it (if not resolve it on the spot).

      The date to purchase by was 3rd March. There were no other promotions or communications that excluded me from this promotion

  • Sorry for the bad experience. I received same email to avail the offer if I pre-order. I place my order on25th Feb for local pick up. Got my s22 ultra on 8th March. After 3-4 days I received my $100 egift card without any issues.

    • Glad to hear your card got given to you, seems like its just me. If Fair trading doesnt work, QCAT will be next

  • You must have been assigned a bad support staff member. I didn't actually get the targetted offer but knew about it through ozbargains. Emailed JB after my S22 Ultra arrived asking when I would get my gift card - they apologised, said they would follow up and emailed me one within 5 or 6 days.

    • I've talked to a couple of people but once they see the response their senior gave in the file, they always give the same response, "You werent on the list"

      • yep just file a complaint to ACCC - you (unlike me) were actually meant to receive this promo and they advertised as such!

    Update:

    Office of Fair Trading contacted JB and JB replied to them accusing me of maipulating the email. Straight to QCAT now
